WHEREAS, Ordinance No. 1323 of the County of Butte empowers the Board of Supervisors
to proclaim the existence or threatened existence of a local emergency when said County is affected
or likely to be affected by a public calamity; and
WHEREAS, said Board of Supervisors has been requested by the Director of Emergency
Services of said County to proclaim the existence of a local emergency therein; and
WHEREAS, said Board of Supervisors does hereby find:
That conditions of extreme peril to the safety of persons and property have arisen within said
County, in that commencing on ar about 8:00 a.m. on Wednesday, May 3, 1995, wide spread
flooding of law lying residential and agricultural areas in Butte County has occurred due to increased
dam releases causing and threatening significant property damage; and
That the aforementioned conditions of extreme peril warrant and necessitate the proclamation
of the existence of a local emergency.
NOW, THEREFORE, IT TS HEREBY PROCLAIlVJED that a local emergency now exists
throughout said County; and
IT IS FURTHER PROCLAIlVIED AND ORDERED that during the existence of said local
emergency the powers, functions and duties of the Director of Emergency Services and the
emergency organization ofthis County shall be those prescribed by state law, by charter, ordinances,
resolutions of this County, and by the County of Butte Emergency Plan, as approved by the Board
of Supervisors on Apri121, 1992.
IT IS FURTHER PROCLAIMED AND ORDERED that said local emergency shall be
deemed to continue to exist until its ternunation is proclaimed by the Board of Supervisors of the
County of Butte, State of California.
PASSED AND ADOPTED by the Butte County Board of Supervisors this 9th day of May,
1995 by the following vote:
AYES: Supervisors Meyer, Dolan, Houx, Thomas and Chair McLaughlin
