GOVERNMENTAL SERVICE FUND AND CLAIMS PROCEDURES
WHEREAS, the County is self-insured pursuant to Gover;nument Cade §9904; and
WHEREAS, self-insurance makes mandatory the operation of a plan and delegation of authority
to pay claims expeditiously; and
WHEREAS, §935.4 and §31000.8 of the Government Code authorizes the Board of
Supervisors to delegate to County staff its approval and payment of claims in amounts of $50,000.00
(Fifty Thousand Dollars) or less; and
WHEREAS, §25260 of the Government Code authorizes the establishment of an interest
bearing self-insurancelintra-governmental service fund which may be used for that purpose; and
WHEREAS, a plan has been developed to facilitate payment of claims within said ]units; and,
WHEREAS, monies appropriated for insurance purposes by the Board of Supervisors shall be
deposited in this fund.
NOW, THEREFORE, BE IT RESOLVED by the Butte County Board of Supervisors:
1. That the Auditor-Controller be authorized to establish aself-insurance/intra-governmental
service fund to properly account for the administration of the self insurance program.
2. That the Risk Manager is hereby authorized to reject claims alleging damages which do not
exceed $5,000.00, or to settle claims which do not exceed $5,000.00, provided the Claims Review
Committee has approved either the claim's rejection or settlement. The Claims Review Commttee shall
also make recommendations to the Board of Supervisors regarding the settlement or rejection of claims
alleging damages in excess of $5,000.00.
3. The Claims Review Committee shall include the Risk Manager, and County Counsel or his
designee. If the Risk Manager and County Counsel or his designee cannot agree on the rejection or
settlement of a claim within their authority, the matter shall be decided by the Chief Administrative
Officer or his designee.
4. Warrants may be drawn upon said funds subject to the procedures approved by the Auditor-
Controller and Claims Review Committee for the settlement of claims and for payment thereof, in
amounts not to exceed $5,000.00 (Five Thousand Dollazs) per claim
5. Fees for outside legal services, claims adjusting services and other related program expenses
will be paid from this fund subject to proper documentation.
BE IT FURTHER RESOLVED by this Boazd that this Resolution supersedes Resolution 79-78
which established a trust account and claims payment procedures effective on May 8, 1979.
PASSED AND ADOPTED by the Butte County Board of Supervisors this 11th day of
July, 1995, by the following vote:
