RESOLUTION ABANDONING A PUBLIC RIGHTS-OF-WAY
(PORTION OF' ORCHARDCREST DRIVE
AND PORTION OF GLEN ARBOR WAY, THERMALITO AREA}
WHEREAS, this matter came on regularly for hearing before the
Board of Supervisors of the County of Butte, State of California, on
August 15 1995, in the Board Chambers, Butte County
Administration Building, Oroville, California; and,
WHEREAS, it appearing to said Board that notice of the time
and place of the hearing on the petition for the abandonment of the
rights-of-way in question was duly and regularly given as required by
law; and,
WHEREAS, testimony and evidence, bath oral and documentary,
having been produced at said hearing, from which said Board now finds
that the hereinafter described public rights-of-way are unnecessary far
present ar prospective public use.
NOW, THEREFORE, IT IS HEREBY ORDERED as follows:
1. That the public rights-of-way situated in the County of
Butte, State of California, as hereinafter more particularly described,
are hereby abandoned pursuant to Chapter 3 of Part 3 of Division 9 of
the California Streets and Highways Code (commencing with Section 8320).
2. That said public rights-of-way so abandoned are located in
the unincorporated area of the County of Butte, State of California, are
identified as a portion of Orchardcrest Drive and a portion Glen Arbor
Way, public roads, in Orchardcrest Subdivision Unit #1, Thermalito area,
and are more particularly described as follows:

Being all of Orchardcrest Drive lying easterly of the easterly
40' right-of-way line of 10th Street, and all of Glen Arbor
Way, as shown on the map of Orchardcrest Subdivision, Unit #1
recorded in Book 130 maps of record at pages 39 to 42, County
of Butte, State of California.
In accordance with California Streets & Highways Code, Section
8340, there is reserved and excepted from the vacation, an
easement and right at any time, or from time to time, to
construct, maintain, operate, replace, remove, enlarge and
renew lines of pipe, conduits, cables, wires, poles, and other
convenient structures, equipment and fixtures for the
operation of gas pipelines, telegraphic and telephone lines,
sanitary sewer, and for the transportation or distribution of
electric energy, and water, and far incidental purposes,
including access to protect such from all hazards in, upon,
and over said streets.
3. That a map showing the rights-of-way hereby abandoned is on
file in the Office of Butte County Department of Public Works, 7 County
Center Drive, Oroville, California 95965.
4. That the Clerk of this Board shall cause a certified copy of
this Resolution, with the seal of the Board of Supervisors of the County
of Butte, State of California, to be recorded in the
office of the Recorder of the County of Butte, State of California.

this 15th day of August , 1995, by the following vote:
