~. 1 `~~ s... ~t`i~ C)~ ice, ~ ~,~L~O~~Zt~tb ~'~ ~'S~71i1f1~~11 .~ti~c~. 95-116 RESOLUTION ESTABLISHING COUNTY SERVICE AREA NO. 164 BUTTE COUNTY ANIMAL CONTROL DISTRICT WHEREAS, pursuant to Title III, Division II, Part 2, Chapter 2.2 of the Government Code of the State of California, commencing with Section 25210.1, the County of Butte has petitioned the Local Agency Farmation Commission ("LAFCO"} for the Formation of County Service Area Na. 164 (Butte County Animal Control District}; and WHEREAS, on the 12th day of July, 1995, LAFCO adopted and passed Resolution #95-02 making determinations and approving the establishment of County Service Area No. 164; and WHEREAS, said Resolution adopted and passed by LAFCo authorized the Board to conduct proceedings far the establishment of County Service Area No. 164; and WHEREAS, the Board of Supervisors hereby finds that Farmation of County Service Area #164 will have no significant effect an the environment and is therefore covered under the General Rule Exemption per Section 15061(b)(3) of the State guidelines far implementation of the California Environmental Quality Act; and WHEREAS, heretofore on the 25th day of July 1995, the Board of Supervisors of the County of Butte, State of California, adopted and passed a Resolution of Intention to establish a County Service Area to be entitled County Service Area No. 164 (Butte County Animal Control District); and WHEREAS, said Resolution fixed the 29th day of August, 1995 at 11:00 a.m. of said day in the Board of Supervisors' Room of the County Administration Building in the City of Oroville, State of California, as the time and place for the public hearing on the establishment of said area; and WHEREAS, said Board at said time and place proceeded to hold said hearing and to hear arguments both for and against the establishment of said area; and WHEREAS, written protests of fifty percent or more of the registered voters residing within the territory proposed to be included in the area, or the owners of one-half or more of the value of the land and improvements in the territory proposed to be included in the area, were not received against the establishment of said area in accordance with Section 25210.17a of the Government Code. WHEREAS, pursuant to Government Code Section 25210.14 the Board of Supervisors ("Board") of the County of Butte may approve said County Service Area after proper public notice and hearing; and NOW THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California, as follows: 1. Said Board hereby finds and determines that the proceedings herein were conducted pursuant to Section 25210.1 et seq. of the Government Code. 2. The boundary lines of the territories proposed for inclusion in the County Service Area are described in Exhibit °A~ attached hereto and made a part hereof by this reference. 3. Said Board hereby determines to approve the Formation of County Service Area #164 (Butte County Animal Control District) as specified below. A. The name proposed for said County Service Area is CSA #164 - Butte County Animal Control District. B. The following type of service is hereby found to be an extended County service and is to be provided within said area: animal control services not provided to the same extent on a countywide basis both within and without cities. C. The Sphere of Influence shall be co-terminus with the District boundaries. 4. In accordance with the provisions of Government Code Section 25210.77a and Butte County Code Sections 21.85 through 21.90, and following a public hearing thereon, a per-parcel service charge shall be levied against parcels within County Service Area No. 164 to support such animal control services. Said charge shall appear as a separate item on the tax bill and shall be collected at the same time and in the same manner as ordinary County ad valorem taxes are collected and shall be subject to the same penalties and the same procedure and sale in the case of delinquency as provided for such taxes. All laws applicable to the levy, collection and enforcement of County ad valorem property taxes shall be applicable to such charge; except that, if for the first year such charge is levied the real property to which such charge relates has been transferred or conveyed to a bona fide purchaser for value, or if a lien of a bona fide encumbrancer for value has been created and attached thereon, prior to the date on which the first installment of said taxes would become delinquent, then the charge confirmed shall not result in a lien against said real property but instead shall be transferred to the unsecured roll for collection. 5. Said County Service Area No. 164 is formed for all purposes subject only to compliance with the requirements of Chapter 8 (commencing with Section 54900), Part I, Division II, Title V of the Government Code and subject to the provisions of Article 2.5 (commencing with Section 25210.21), Chapter 2.2, Part II, Division II, Title III of the Government Gode of the State of Galifarnia.
