RESOLUTION TERMINATING TEMPORARY MORATORIUM ON
ISSUANCE OF CERTAIN WATER WELL PERMITS
WHEREAS, on September 13, 1994, the Berard of Supervisors
adopted Resolution No. 94-105 entitled "Proclaiming Emergency
Caused by Draught and Imposing Temporary Moratorium on Issuance of
Permits far Construction ar Deepening Water Wells"; and
WHEREAS, on November 8, 1994, the Board of Supervisors adopted
Resolution 94-131 revising the area subject to the moratorium; and
WHEREAS, during the summer of 1994, portions of the Butte
groundwater basin experienced significant adverse impacts from a
combination of years of drought and increased groundwater pumping.
The moratorium was prompted by serious concerns over the cumulative
short-term and long-term impacts on the Butte groundwater basin of
pumping from new wells when added to this increased pumping from
existing wells; and
WHEREAS, the substantial rains and surface water flows through
the County experienced during this water year have allowed the
Butte groundwater basin to recover from the adverse impacts
experienced during the prior water year; and
WHEREAS, the groundwater hydrological modeling and studies and
an assessment of ,the Butte groundwater basin are ongoing and will
be continued and completed in order to determine the safe yield of
the groundwater basin, the causes of its depletion, and the extent
to which County groundwater management rules should be modified or
enacted.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the Board of
Supervisors of the County of Butte that Resolution Nos. 94-105 and
94-131 are hereby repealed, effective immediately, thereby
terminating the moratorium on issuance of certain water well
permits.
PASSED AND ADOPTED by the Board of Supervisors of the County
of Butte, State of California, on the 12th day of September ,
1995, by the following vote:
AYES: Supervisors Meyer, Dolan, Houx, Thomas and Chair McLaughlin
