BUTTE, STATE OF CALIFORNIA, IN ACCORDANCE WITH REVENUE AND
TAXATION CODE SECTION 95.3E
WHEREAS, Revenue and Taxation Code Section 95.31 provides that the County
may elect to participate in the State-County Property Tax Administration Program,
administered by the State, upon recommendation of the Assessor, and by resolution of the
Board of Supervisors, adopted not later than December 1 of the fiscal year which it is to
apply; and
WHEREAS, pending the execution of a satisfactory contractual agreement, the
County elects to participate in the State~County Property Tax Administration Program
and to apply for a loan of $381,95G for fiscal year 1995-96; the County may make a
similar election for fiscal years 1996-97 and 1997-98, or may elect to apply for a loan in a
lesser amount; and
WHEREAS, the County finds it necessary to apply for this loan to enhance its
property tax administration system; reduce backlogs of new construction, changes in
ownership, Froposition 8 declines in value; restore misfortune and calamity property
values; prepare a defense for each Appeals case that is scheduled by the Assessment
Appeals Board; and
WHEREAS, in order to participate in the State County Property Tax
Administration Program, the County must enter into a contractual agreement with the
State Department of Finance;
WHEREAS, the Director of the Department of Finance shall determine whether
the County has satisfied the terms and repaid the loan upon receipt of certification of the
performance measures enumerated in the contractual agreement by the County Auditor;
and
WHEREAS, the Butte County Assessor believes he or she can satisfactorily meet
those terms, and,
WHEREAS, the funds obtained through this program shall not be used to
supplant the current level of funding; and
WHEREAS, such funding must equal the level in the 1994-95 fiscal year
exclusive of the amount $80,193 provided to the Assessor's Office pursuant to Item 9100-
102-001 of the Budget Act of 1994 {however, in a county in which the 1994/95 funding
level for the Assessor's office was higher than the 1993-941eve1, the 1993-94 fiscal year
staffmg and funding levels shall be considered the base year for purposes of this
provision}; and
WHEREAS, that funding level as determined by the Assessor's Office and the
Chief Administrative Office of the County, is $1,885,606; and
WHEREAS, it is in the best interest of Butte County to take advantage of this
program because it provides much needed funding for property tax administration.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
SUPERVISORS OF THE COUNTY OF BUTTE AS FOLLOWS:
The County of Butte intends to participate in the State-County Property Tax
Administration Program and directs the County Administrative Officer with the advice
and assistance of the Assessor to enter into negotiations for the purpose of producing a
contractual agreement with the State Department of Finance to secure a Ioan, as provided
by Section 95.31 of the Revenue and Taxation Code, for each of the 1995-96, 1996-97,
1997-98 f scat years. Upon satisfactory completion of the negotiations, the contractual
agreement shall be submitted to the board for approval.
This resolution shall remain operative until rescinded, but in no event shall it
remain operative beyond June 30, 2000 unless otherwise permitted or authorized by law.

day of November, 1995, by the following vote:
