HomeMy WebLinkAbout95-171•--aa^ ^asr-,i ~~' O~ SUP,~+ ~•' ~ ~i :O ~ 'O= =~= BOARD OF SUPERVISORS . ~: .~. i* *~ COUNTY OF BUTTE, STATE OF CALIFORNIA ~i-!~' 1,1'~•~~..~.v'~V~~ ~t'SO~i1f1011 ~l'0. 95-171 RESOLUTION CALLING AN ELECTION REGARDING AN APPROVAL OF UTILITY USER TAX WHEREAS, The Board of Supervisors of the County of Butte has adopted Ordinance Number 3229 levying a utility user tax in the unincorporated area of the County pursuant to Revenue and Taxation Code Section ?284.2; WHEREAS, said utility user tax is subject to the voter approval requirement specified in Government Code Section 53723 and may not be imposed until it is submitted to the County electorate of the unincorporated area of the County and approved by majority vote of the those voters voting in an election on the issue; and WHEREAS this Board wishes to submit said Utility User Tax measure to the County electorate of the unincorporated area of the County at the statewide primary election to be held on March 26, 1996. NOW, THEREFORE, BE IT RESOLVED, by the Board of Supervisors of the County of Butte, State of California, as follows: 1. The Board hereby calls a special election to be held within the County of Butte on March 26, 1996. 2. The question to be submitted to the County voters in the unincorporated areas of the County at said election shall be: In order to maintain the current level of County services, including fire protection, law enforcement, criminal prosecution Page 1 3. 4. 5. 6. and library services, shall the Utility User Tax levied in the unincorporated area of Butte County by Ordinance Number 3229 be approved, thereby continuing the tax at its current rate until the year 2000, at which time the tax shall expire? This Ordinance is attached hereto as Exhibit A and incorporated herein by this reference. Said election shall be consolidated with the statewide primary election to be held on March 26, 1996. Said election shall be held and conducted pursuant to the procedures specified in Part 3 of Division 10 of tYie Elections Code commencing at Section 10400. For the purposes of this election, and Ordinance Number 3229, the "County eaters" and the "County electorate" shall include only the voters in the unincorporated area of the County. In accordance with Elections Code Section 13247, the County Clerk is authorized to abbreviate the above measure to be submitted to the voters of the unincorporated areas of the County, only, to read as follows: UTILITY USER TAX In order to maintain the current level of County services, including fire protection, law enforcement, criminal prosecution and library services, shall the Utility User Tax levied in the unincorporated area of Butte County by Ordinance Number 3229 be approved, thereby continuing the tax at its current rate until the year 2000, at which time the tax shall expire?
