HomeMy WebLinkAbout96-011WHEREAS, the Butte County Sheriff's Office patrols the Thermalito Afterbay pursuant to a
contact between the Sheriff's Office and the California Department of Water Resources; and
WHEREAS, there is presently a planned and scheduled boat racing time trial event at the
Thermalito Afterbay for the "Bud David Memorial Time Trials" beginning at dusk on February 16th,
1996, and will continue through Saturday, the 17th, and Sunday, the 18th, 1996, ending at sunset
on Sunday, the 18th, 1996.
WHEREAS, in light of said events, the Sponsor of the event tAmerican Power Boat Association)
and the Butte County Sheriff's Office have requested that the Butte County Board of Supervisors
authorize the partial public closure of the Thermalito Afterbay, specifically the area between Highway
162 to Hamilton Road, and from Highway 99 to the Easterly Right of Way Boundary, between the
hours of dusk on February 16th thru sunset on February 18th, 1996, for the purpose of conducting
speedboat timed racing; and
WHEREAS, such public closure appears in the best interest of the public.
NOW, THEREFORE, BE IT RESOLVED that exclusive use of the Thermalito Afterbay body of
water will be granted to American Power Boat Association for the purpose of presenting the racing
time trial events and the public will not be permitted use of the aforementioned body of water for the
aforementioned dates and times specified.

1996, by the following vote:

Permission is hereby granted to the undersigned permittee to enter upon the property of the
Department of Water Resources, hereafter referred to as the "State":
Location: South Forebay
Between: Highway 762 South to Hamilton Road, and from Ni.ghway ,99 to the Easterly Fight
of Way Boundary
Purpose: Closure of South Afterbay at dusk an 02/16196 through 02/78196 to conduct
speedboat timed racing.
Equipment to be used on this property is limited to the following: boats, trailers, vehicles,
electronic equipment, various other items needed for the operation of timed racing;
2. Permittee is responsible for the injury or death of any workman, member of the public, officer ar
employee of the State, County, City, or any other person, arising out of the exercise of the
rights herein granted, irrespective of fault or negligence, excepting only such injuries or deaths
as are caused by the sole negligence or willful misconduct of the State, and its officers ar
employees;
Permittee shall indemnify and save harmless the State and its officers and employees from all
claims, suits or actions of any nature brought for or an account of any such injury or death:
3. In the exercise of the rights herein granted, permittee is responsible for any damage..
destruction or loss occurring to the property or facilities of the State, water contractors,
licensees, permittees, or members of the public;
Permittee shall indemnify and save harmless the State, its officers or emnloy_ ees for all such
damage, destruction or loss; -
4. This permit is not valid for any activity that results in permanent alterations to State property
nor for a period in excess of 60 {sixty} days from date of issuance;
5. This permit may be canceled by either party upon 3 {three) days written notice to the other
party;
6. Permittee shall provide an insurance Certificate of Coverage in the amount of one million
dollars {51,000,000} including the State as "additional insured" during this event.
