HomeMy WebLinkAbout96-012R~~solufio~l Resolution Designating the District Attorney to Assume Responsibility for Proceedings Under Welfare and Institutions Code Section 6601 WHEREAS, the State Legislature in 1995 passed the Sexually Violent Predators Act (AB 888) now codified as Welfare and Institutions Code Section 6601; and WHEREAS, that act requires that certain inmates under commitment to the Department of Corrections be evaluated for commitment as "Sexually Violent Predators;" and WHEREAS, that act requires that either the County's District Attorney or County Counsel be designated by the Board of Supervisors to undertake those commitment proceedings; and WHEREAS, the County Counsel, the Director of Mental Health and the District Attorney have all concurred that the District Attorney should assume this responsibility. NOW, THEREFORE, BE IT RESOLVED, by the Butte County Board of Supervisors, that: 1. The County's District Attorney shall assume responsibility for those proceedings provided for under Welfare and Institutions Code Section 6601.
