L'OUIS?'~i~~~ i N CrJU~~"1F C3~E" ,t~~, Sl`ATE~ Cam'' ~~~~`1A ~~~* , ~ ~~~~st~llifi~>ia ~~~~~. 96-18 RESOLUTION APPROVING THE EXPANSION OF POWERS TO CSA NO. 135 (KEEPER CREEK ESTATES SUBDIVISION) TO INCLUDE THE OPERATION, MAINTENANCE AND REPAIR OF SEWAGE COLLECTION FACILITIES WHEREAS, on August 28, 1990, the Board of Supervisors of the County of Butte, State of California, adopted and passed Resolution No. 90-127 establishing County Service Area No. 135; and WHEREAS, on December 7, 1995, the Butte Local Agency Formation Commission {LAFCo) adapted and passed Resolution No. 96-13 making determinations and approving the Expansion of Powers of CSA #135 to include the operation, maintenance and repair of sewage collection facilities; and WHEREAS, a Negative Declaration with mitigation measures was adapted by the Butte County Development Review Committee on February 13, 1995; and WHEREAS, LAFCo has certified that it has reviewed and considered the Negative Declaration with mitigation measures and that there are no sufficient grounds to require supplementing said environmental document; and WHEREAS, the application for the Expansion of Powers of CSA #135 has 100% signature of the property owners, and this Board is therefore authorized to proceed without holding a public hearing. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California, as follows: Section 1. Environmental Findings A. This Board certifies that it has independently reviewed and considered the Negative Declaration with mitigation measures prepared by the Butte County Planning Division and adopted by the Butte County Development Review Committee on February 13, 1995 and find that there are no sufficient grounds to require supplementing said environmental document. Section 2. Conditions A. The services to be provided are the operation, maintenance and repair of sewage collection facilities. B, The expansion of powers is limited to Keefer Creek Estates, Phase II, which shall be designated as a "zone of benefit'°. C. The CSA shall provide adequate resources for the compliance with all monitoring and other Regional Water Quality Control Board Waste Discharge Requirements. D. The CSA shall provide adequate resources and/or a mechanism to insure adequate funding of a major sewage treatment and a disposal facility replacement or reconstruction if necessary. E. The map and legal description shall be corrected to meet the requirements of LAFCa and the Butte County Director of Public Works prior to filing the Certificate of Completion. F. All Butte County and State of California fees must be paid in full prior to filing the Certificate of Completion. Section 3. Said Board hereby finds and determines that the proceedings herein were conducted pursuant to Section 25210.1 et seq. of the Government Code; Section 4. The following type of service is found to be an additional extended service: the operation, maintenance and repair of sewage collection facilities. Section 5. In accordance with the provisions of Government Code Section 25210.77a and Butte County Code Sections 21-85 through 21-90, and following a public hearing thereon, aper-parcel service charge shall be levied against all the parcels within County Service Area No. 135. Each parcel shall be assessed an individual service charge based upon benefit. Said charge shall appear as a separate item on the tax bill and shall be collected at the same time and in the same manner as ordinary county ad valorem property taxes are collected and shall be subject to the same penalties and the same procedure and sale in case of delinquency as provided for such taxes. All laws applicable to the levy, collection and enforcement of county ad valorem taxes shall be applicable to such charge; except that if for the first year such charge is levied, the real property to which such charge relates has been transferred or conveyed to a bona fide purchaser for value, or if a lien of a bona fide encumbrancer for value has been created and attaches thereon, prior to the date on which the first installment of said taxes would become delinquent, the charge confirmed shall not result in a lien against such real property but instead shall be transferred to the unsecured roll for collection.
