RESOLUTION APPROVING AND EXECUTING THE REVISED
AGREEMENT BETWEEN THE
OROVILLE-WYANDOTTE IRRIGATION DISTRICT AND BUTTE COUNTY
REGARDING THE EXCHANGE OF
PROPERTY TAX REVENUE RELATED TO ANNEXATIONS
WHEREAS, the Butte County Board of Supervisors adopted Resolution No. 81-91
entering into a Property Tax Exchange Agreement with the Oroville-Wyandotte Irrigation District; and
WHEREAS, the current Property Tax Agreement requires each annexation to the district
to have approval of the Tax Exchange by Butte County and the District; and
WHEREAS, the Revised Property Tax Agreement leaves in place the current agreement
that the District will receive no share of property tax from Butte County; and
WHEREAS, the Revised Property Tax Agreement will relieve both Butte County and the
District from reviewing and adapting a Property Tax Agreement for each annexation.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Supervisors of the County of
Butte that the Property Tax Agreement adopted by Resolution No. 81-91 is superseded by the Revised
Property Tax Agreement attached hereto and the Chairman of the Board of Supervisors is authorized to
sign said Agreement.

California, on theL3rd day of July 1996, by the following votes:

PROPERTY TAX TRANSFER AGREEMENT
BUTTE COUNTY AND OROVILLE WYANDOTTE IRRIGATION DISTRICT
THIS AGREEMENT is made and entered into this day of , 19 , by and between
the County of Butte, a political subdivision of the State of California, and the Oroville-Wyandotte Irrigation
District, an independent special district authorized by Division 11 of the Water Code of the State of
California.
WHEREAS, part 0.5 of Division 1, Section 99, Subsection (b), Paragraph 5 of the Revenue and Taxation
Code provides as (allows:
!n the event that......a jurisdictional change would affect the service area or service responsibility
of one or mare special districts, the Board of Supervisors of the county or counties in which.....
(the} districts are located shall, on behalf of the district or districts, negotiate any exchange of
property tax revenues.
WHEREAS, said section of the Revenue and Taxation Code further provides in Section 99.01, Subsection
(a), Paragraph 3:
Notwithstanding the provisions of paragraph (5) of subdivision (b) of Section 99, any special district
affected by the jurisdictional change may negotiate on its own behalf, if it so chooses.
WHEREAS, Section 99 further provides in Subsection (d):
With respect to adjustments in the allocation of property taxes pursuant to this section, a county
and any Ioca! agency or agencies within the county may develop and adopt a master property tax
transfer agreement. Such agreement may be revised from time to time by the parties subject to
such agreement.
WHEREAS, the Board of Directors of the Oraville-Wyandotte Irrigation District and the Board of Supervisors
of the County of Butte find that this Master Property Tax Exchange Agreement will produce substantial
revenue neutrality in annexations to the District. Such annexations do not normally result in any transfer
of services which would justify a transfer of property tax revenue.
NOW, THEREFORE, in consideration of the premises set forth herein, the parties hereto agree that no
property tax transfer will occur as a result of any annexation of territory to the Oroville-Wyandotte Irrigation
District hereafter and until either party hereto notifies the other of the termination of this agreement.
IN WITNESS WHEREOF, the parties hereto have executed this agreement on the date set forth above.
