HomeMy WebLinkAbout96-087~~~ ~'~ ~~ Up~,~~i~ ~~.........~i • ~a°o =>~n~ BOARD OF SUPERVISOR ~.~„ COUNTY OF BUTTE, STATE QF CALIFORNIA ~.• ~ ~i1~~~s~nn~~•+~ ~~~ ~C'SOtUf10T1 ~~l). 9~-8~ +•~11 ~QUx' 1~~~ rrrr~rtia~rr RESOLUTION ABANDONING A PUBLIC SERVICE EASEMENT (PORTION OF SANITARY SEWER EASEMENT, STIRLING CITY AREA) WHEREAS, this matter came an regularly for hearing before the Board of Supervisors of the County of Butte, State of California, on July 23 1996, in the Board Chambers, Butte County Administration Building, Oroville, California; and, WHEREAS, it appearing to said Board that notice of the time and place of the hearing on the petition for the abandonment of the public service easement in question was duly and regularly given as required by law; and, WHEREAS, testimony and evidence, both oral and documentary, having been produced at said hearing, from which said Board now finds that the hereinafter described public service easement is unnecessary for present or prospective public use. NOW, THEREFORE, IT IS HEREBY ORDERED as follows: 1. That the public service easement situated in the County of Butte, State of California, as hereinafter more particularly described, is hereby abandoned pursuant to Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Code (commencing with Section 8320). 2. That said public service easement so abandoned is located in the unincorporated area of the County of Butte, in the Stirling City area, State of California, is on property identified as AP 059-230-012, 014 and 015, and is mare particularly described as follows: Being a portion of that certain 20-foot wide Sewer Easement lying within T 24N, R4E, Section 28, M.D.M.; also being a portion of Lots 10, 12 and 13 of Block B as shown on the Official Map of Stirling City as filed in Book 4 of maps at Page 33 on file in the Office of the Recorder of the County of Butte, State of California August 3, 1903, and also described in a Grant Deed Easement to the County of Butte, from Diamond National Corporation recorded September 6, 1960 in Book 1075 of Official Records at Pages 470 and 471 and being more particularly described as follows: Beginning at a point on the centerline of the 20-foot wide easement at its Point of Intersection with the northerly lot line of Lat 13 of said Block B, said Point of Intersection lies 54 feet more or less easterly of the westerly lot line of said Lot 13; thence in a southerly direction along said centerline parallel to the westerly lines of Lots 13, 12 and 10 of said Block B, 132 feet more or less to a point, said point lies 32 feet southerly of the mast northerly lot line of Lot 10 of said Block B and at the end of the portion of the 20 foot wide sewer easement to be abandoned. 3. That a map showing the public service easement hereby abandoned is on file in the Office of Butte County Department of Public Works, 7 County Center Drive, Oroville, California 95965. 4. That the Clerk of this Board shall cause a certified copy of this Resolution, with the seal of the Board of Supervisors of the County of Butte, State of California, to be recorded in the Office of the Recorder of the County of Butte, State of California.
