' ~ :~^ ^ ^ • * ; ~ *; .~~ ~y~1 •~~+ ~~L,UUIS,~~~•. ~^^^ BOARD OF SUPERVISORS COUNTY OF BUTTE, STATE OF CALIFORNIA ~c~solufion No. 96-96 RESOLUTION ABANDONING PUBLIC RIGHTS-OF-WAY (PORTION OF LOTS 113 AND 152, TOWN OF RICHVALE) WHEREAS, this matter came on regularly for hearing before the Board of Supervisors of the County of Butte, State of California, on August 13 , 1996, in the Board Chambers, Butte County Administration Building, Oroville, California; and, WHEREAS, it appearing to said Board that notice of the time and place of the hearing on the petition for the abandonment of the rights-of-way in question was duly and regularly given as required by law and at least two of the petitioners are residents of the road district in which the right-of-way is situated; and, WHEREAS, testimony and evidence, both oral and documentary, having been produced at said hearing, from which said Board now finds that the hereinafter described public rights-of-way are unnecessary for present or prospective public use. NOW, THEREFORE, IT IS HEREBY ORDERED as follows: 1. That the public rights-of-way situated in the County of Butte, State of California, as hereinafter more particularly described, are hereby abandoned pursuant to Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Code (commencing with Section 8320). 2. That said public rights-of-way so abandoned are located in the unincorporated area of the County of Butte, State of 1 California, are identified as portions of public rights-of-way on portions of Lots 113 and 152 of the Town of Richvale, and are more particularly described as follows: A portion of Section 16, Township 19 North, Range 2 East, M.D.M., Butte County, State of California, and being more particularly described as follows: Being a portion of lots 152 and 113 of the Town of Richvale, as shown in Book 6 of maps at Page 53, on file in the Office of the Recorder, County of Butte, State of California. Parcel NO. 1-A Being the northerly 10 feet of said Lot 152 of the Town of Richvale, excepting therefrom the following described area: Beginning at the northeast corner of said Lot 152; thence southerly along the easterly line of said Lot 152, a distance of 10.00 feet; thence leaving said easterly line, westerly, 10.00 feet southerly of and parallel with the northerly line of said Lot 152, a distance of 20.00 feet to a point of cusp and beginning of a curve concave to the northwest, having a radius of 20.00 feet and a radial line perpendicular to the said northerly line of Lot 152; thence northeasterly along the arc of said curve to its intersection with said northerly line of Lot 152; thence easterly along said northerly line to the point of beginning. Parcel No. 1B Being the southerly 10 feet of said Lot 152 of the Town of Richvale, excepting therefrom the following described area: Beginning at the southeast corner of said Lot 152; thence northerly along the easterly line of said Lot 152, a distance of 10.00 feet; thence leaving said easterly line, westerly, 10.00 feet northerly of and parallel with the southerly line of said Lot 152, a distance of 20.00 feet to a point of cusp and beginning of a curve concave to the southwest, having a radius of 20.00 feet and a radial line perpendicular to said southerly line of Lot 152; thence southeasterly along the arc of said curve to its intersection with said southerly line of Lot 152; thence easterly along said southerly line to the Point of Beginning. Parcel No. 2 Being all of that portion of said Lot 113 of the Town of Richvale lying between the easterly prolongation of the northerly line of Lot 162 and the easterly prolongation 2 of the southerly line of Lot 163 of said Town of Richvale. EXCEPTING AND RESERVING, as to Parcel Nos. lA, 1B and 2, any existing public service easement and/or rights at any time, or from time to time, to maintain, operate, replace, remove, renew and enlarge the existing public service facilities and facilities incidental thereto, including access to protect the property from all hazards in, upon, and over the highway herewith to be abandoned. 3. That a map showing the rights-of-way hereby abandoned is on file in the Office of Butte County Department of Public Works, 7 County Center Drive, Oroville, California 95965. 4. That the Clerk of this Board shall cause a certified copy of this Resolution, with the seal of the Board of Supervisors of the County of Butte, State of California, to be recorded in the office of the Recorder of the County of Butte, State of California.
