WHEREAS, on August 28, 1990, the Board of Supervisors of the County of Butte, State of California, adopted and passed Resolution No. 90-127 establishing County Service Area No. 135 Keefer Creek Estates}; and WHEREAS, on August 1, 1996, the Butte County Lora[ Agency Formation Commission ("LAFCo") adopted and passed Resolution No. 96-32 making determinations and approving the annexation to County Service Area No. 135 for the purpose of maintenance of sewage collection facilities; and WHEREAS, a Negative Declaration with mitigation measures was filed by the Department of Development Services, Planning Division on September 28, 1995; and WHEREAS, LAFCo has certified that it has reviewed and considered the Negative Declaration with mitigation measures and there are no sufficient grounds to require supplementing it; and WHEREAS, the application for the annexation to County Service Area Na. 135 has 1Qp% signature of the property owners, and this Board is therefore authorized to proceed without holding a public hearing. NOW THEREFORE, BE 1T RESOLVED, by the Board of Supervisors of the County of Butte, State of California, as follows: RESOLUTION APPROVING THE ANNEKATION TO COUNTY SERVICE AREA NO. '135 (KEEPER CREEK ESTATES) 1. Said Board hereby finds and determines that the proceedings herein were conducted pursuant to Section 25210.1 et seq. of the Government Code. 2. Said Board hereby determines to approve the annexation to County Service Area No. 135 {Keefer Creek Estates) as specified below: a. Said Board certifies that it has independently reviewed and considered the Negative Declaration with mitigation measures prepared by the Department of Development Services, Planning Division, and filed on September 28, 1995, and there are no sufficient grounds to require supplementing it. 3. The short farm designation of these proceedings is: 96-22 - Annexation to CSA #135 {Keefer Creek Estates). 4. The following types of services are found to be an additional extended service and is to be provided within the said area: maintenance of sewage collection facilities. 5. In accordance with the provisions of Government Code Section 25210.77a and butte County Code Section 21.85 through 21.80, and following a public hearing thereon, aper-parcel service charge shall be levied against all the parcels within County Service Area No. 135. Each parcel shall be assessed an individual service charge based upon benefit. Said charge shall appear as a separate item on the tax bill and shall be collected at the same time and in the same manner as ordinary county ad valorem property taxes are collected and shall be subject to the same penalties and the same procedures and sale in case of delinquency as provided for such taxes, All laws applicable to the levy, collection and en#orcement of county ad valorem taxes shall be applicable to such charge; except that if for the first year such charge is levied, the real property to which such charge relates has been transferred or conveyed to a bona fide purchaser for value, or if a lien of a bona fide encumbrancer for value has been created and attaches thereof, prior to the date on which the first installment of said taxes would become delinquent, the charge confirmed shall not result in a lien against such real property but instead shall be transferred to the unsecured roll for collection.
