JUSTIN MANOR SUBDIVlS1ON
WHEREAS, pursuant to Title 111, Division 71, Part 2, Chapter 2.2 of the Government Code of the
State of California, commencing with Section 25210.1, Jon Gregoire and Tom Nix petitioned the Local
Agency Formation Commission (LAFCo) for establishment of County Service Area No. 165; and
WHEREAS, on the 3rd day of August, 1995, LAFCo adopted and passed Resolution No. 95-05
making determinations and approving the establishment of County Service Area No. 165; and
WHEREAS, said Resolution adopted and passed by LAFCo authorized the Board of Supervisors
(Board) of the County of Butte to conduct proceedings for the establishment of County Service Area No.
165 without notice and hearing and the Board may proceed in such manner pursuant to Government Code
Section 25210.4; and
WHEREAS, pursuant to Government Code Section 25210.14, the Board of Supervisors of the
County of Butte may approve said County Service Area wi#hout notice of hearing.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte, State
of California, as follows:
1. Said Board hereby finds and determines that the proceedings herein were conducted pursuant to
Section 25210.1 et seq of the Government Code.
2. The Board hereby determines #o establish said County Service Area without notice and hearing.
3. The boundaries of said County Service Area are hereby finally determined and established to be
the same as shown on Exhibit "A" attached hereto and incorporated herein and made a part hereof by this
reference,
4. The name of said County Service Area No. 165 is Justin Manor Subdivision. (LAFCo File No. 95-
27).
5. The following types of services are hereby found to be extended County services and are to be
provided within said area: maintenance of drainage facilities, street lighting, and operation and maintenance
of a fire protection system.
6. The Sphere of Influence shall be coterminous with the boundary of said County Service Area No.
165,
7. In accordance with the provisions of Government Code Section 252i0.77a and Butte County Code
Sections 21.85 through 21,90, and following a public hearing thereon, aper-parcel service charge shall be
levied against all the parcels within County Service Area No. 165. Each parcel shall be assessed an
and shall be collected at the same time and in the same manner as ordinary county ad valorem #axes are
collected and shall be subject to the same penalties and the same procedure and sale in the case of
delinquency as provided for such taxes. AI[ laws applicable to the levy, collection and en#orcement of
county ad valorem taxes are collected and shall be subject to the same penalties and the same procedure
and sale in the case of delinquency as provided for such taxes. All laws applicable to the levy, collection
and enforcement of County ad valorem taxes shall be applicable to such charge, except that if real property
to which such charge related has been transferred or conveyed to a bona fide purchaser for value, or if
alien of a bona fide encumbrancer, for value has been created and attached thereon, prior to the date on
which the first installment of said taxes wou Id become delinquent, then the charge confirmed shall not result
in a lien against said real proper#y but instead shall be transferred to the unsecured roll for collection.
8. Said County Service Area is formed for all purposes subject only to compliance with the
requirements of Chapter 8 commencing with Section 54900, Part 1, Division 11, Title V of the Government
Code and subject to the provisions of Article 2.5 commending with Section 25210.21, Chapter 2.2, Part 17 ,
Division 11, Title 111 of the Government Code of the State of California.
PASSED AND ADOPTED by the Board of Supervisors of the County of Butte, State of California,
on the 27th day of August , 1996, by the following vote:

All that certain real property situate in the County of Butte, State of California, described as
follows;
COMMENCIlVG at the intersection of the centexlime of State Highway 99 and the
centerlime of Garden Brook Drive;
THENCE leaving said point of commencement and along said centerline of Garden Brook
Drhre North 52° 18' 00" East a distance of 847.96 feet;
THENCE leaving said centerline of Garden Brook Drive North 37° 42' 00" West a distance
of30.40 feet to a point on the northerly right of way line of said Garden Brook Drive and a
point on the southerly lie of Lot 1 as said lot is shown on that certain znap entitled "Map of
the Holmes Tract Near Chico, Butte County, California" recorded in the Office of the
Recorder of the County of Butte, State of Califonua;
THENCE leaving said northerly line of Garden Brook Drive and along the southerly line of
said Lot 1 and the southerly line of Lot 3 of said Holmes Tract North 52° 18' 00" East a
distance of 388.90 feet to the TRUE POINT OF BEGINNING for the pazcel ofland herein
described;
THENCE from said paint of beginning and leaving said southerly line North 37° 42' 36"
