HomeMy WebLinkAbout96-133Reso~ufion No. 96-133 WHEREAS, the Caunty previously approved the Copra Subdivision Map identified above; and WHEREAS, said Subdivision Map included an offer of dedication of V-2 Road Extension, a sixty-foot wide non-exclusive easement for street purposes ("easement"), as described in Exhibit A attached hereto; and WHEREAS, the affected property owner wishes to relocate said easement to a mutually agreed upon location and to make an offer of dedication of said easement in the new location to the County of Butte; and WHEREAS, upon said relocation the offer of dedication of the easement in its original location will not be necessary for the public or County use; and WHEREAS, the offer of dedication of the easement in its new location, as described in Exhibit B attached hereto, may be necessary for the public or Caunty use at a future time; and WHEREAS, the said offers of dedication to be exchanged are of equal value; and WHEREAS, said exchange and the termination and abandonment of the offer of dedication of the easement in its original location will not cut RESOLUTION EXCHANGING OFFER OF RIGHT-OF-WAY DEDICATION O-2 ROAD EXTENSION CROSSING LOT 1, "COPRA SUBDIVISION", BOOK 85 MAPS PAGES 7~ & 71 off any access to any person's property which, prior to relocation, adjoined said easement and, will not terminate any public service easement, NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte as follows: 1. The offer of dedication of the said easement in its original location, as described in Exhibit A attached hereto, is terminated and abandoned pursuant to Government Code Section 66477.2(c} and Streets and Highways Code Section 833U and is exchanged for the offer of dedication described in Exhibit B attached hereto, pursuant to Government Code Section 25365. 2. Said termination .and abandonment and exchange shall be effected upon recordation of this resolution.
