Purpose. The declared purposes of this ordinance is to provide for the preparation and carrying ~t of plans for the protection of persons and property within the County of Butte in the event of a disaster, and to provide for the coor- dination of civil disaster functions of the County of Bu*_te with the cities of Chico, Oroville, Gridley, and Biggs, and all other affected public agencies, corporations and organizations within the County of Butte. SECTION 8-2. Definitions. '. A. Civil Defense. As used in this .ordinance, the term "civil defense" shall mean the preparation for the carrying out of all emergency functions, other than functions for which the military forces are primarily responsible, to prevent and minimize injury aad damage resulting from disasters. B. Disaster. As used in this ordinance, the term."disaster shall mean actual or threatened enemy attack, sabotage, extra- ordinary fire, flood, storm, epidemic, riot, earthqua'.~ce, or other similar public calamity. It slAall. not include, nor does any provision of this ordinance apply to, any condition relating to labor controversy. C. State of Disaster. As used in this ordinance, a "state of disaster" ,when proclaimed by the Governor, means the existQnc~ of conditions of extreme peril to the safety of persons and prop- i erty within the area, caused. by such conditions as air pollution, ~, i ri 2 3 4 6 6 7 8 9 10 z~ ].2 i 23 14 Z5 I Z6 I Z7 ~.8 19 20 21 22 23 24 25 2s 2'7 28 29 30 - _--- 31 ~ 32 fire, flood, storm, epidemic, riot, or earthquake, or other conditions, except as a result of war-caused disaster, which conditions, by reason of their magnitude, are, or.are likely to be, beyond the control of the services, personnel, equipment, and facilities of any single county, city and county, or city, and require the combined forces of a mutual aid region or regions to combat. It shall not include, nor does any provision of this ordinance apply to, any condition relating to labor controversy. D. State of Extreme :~mergency. As used in this ordinance, a "state of extreme emergency", when proclaimed by the Governor, .means the existence of conditions of extreme peril to the safety of persons and property within the state, caused by immediate attack, or threatened attack, by land, seas, or air, or that. upon the advice of.the commanding general of this area, such an attack is imminent, an air raid alarm, sabotage, or other cause such as air pollution, fire, flood, storm, epidemic, riot, or earthquake, which conditia-~s }iy reason of their magnitude are, or are likely to be, beyand the control of the services, personnel, equipment, and facilities, or any single county, city and county, or city, and require the combined forces of a "mutual aid region or regions" to combat. "State of extreme emergency" does not include nor apply to~ any condition resulting from labor controversy. A "state of extreme emergency" exists immediately and with- out a proclamation thereof by the Governor whenever this state is attacked by an enemy of the United States, or upon receipt by the Calirornia Disaster Office of a warning from the Air Force, or other authorized federal agency, indicating that such an enemy attack is probable or imminent. E'. National Plan. State Plan. As used in the ordinance, the term "state plan" refers to the California Civil Defense and Disaster Plan promulgated by the Governor of the State of California for imple- mentation in the event of a disaster affecting all or cart of the State of California. G. Butte County Civil Disaster Operational Area. As used in this ordinance, the term "Butte County Disaster Operational Area" refers to the unincorporated areas of the County of Butte, and the incorporated areas oz the cities. of Chico, Oroville, ~ Gridley, and Biggs. H. Cities. As used in this ordinance, the term "cities" it refers to the cities of Chico, Oroville, Gridley, and Biggs. I. Service Chief. As used in this ordinance, the term "Service Chief" refers to any person who has been appointed in I' accordance with this ordinance, and who controls and directs in- dividuals or employees performing emergency functions such as law enforcement, fire, medical and health, emergency welfare, and other public services in the protection of life and propert~i within the Butte County Civil Disaster Operational Area. SECTION 8-3. Civil Disaster Council.. The Butte County Disaster Council is hereby created and shall consist of the following: '` A. Two members of the Board of Supervisors of the County, one of whom shall be the chairman of the Board of Supervisors. B. The Mayor of each city in the county, or councilman selected by the Mayor of each city. C. The Sheriff. D. The County Superin*_enden*_ of Schools. E. The County Administrative Officer, the City Manager, or other administrative emplajee, as determined by each city council, who shall serve as an ex-officio member of the Civil Disaster 32I~ Council without vote. - - - 3. i', , 7. 2 3 4 b 6 7 8 9 10 11 12 13 14 15 I6 Z7 18' 19 2a 21 22 23 24 25 26 2'7 28 29 30 SECTION 8-4. Civil. Disaster Council.. Powers and Duties. It shall be the duty of the Butte County Civil Disaster Council, and it is hereby .empowered, to review and recommend for adoption by the Board of Supervisors and city councils, civil defense and disaster and mutual aid plans and agreements, and such ordinances and resolutions, and .rules and regulations, as are necessary to implement such plans and agreements. The members of the Civil Disaster Council shall elect a chairman, vice-chairman, and such other officers as they deem necessary and they shall pre- scribe their own rules of procedure. The Civil Disaster Council shall meet upon call of the chairman, or, in his absence from the county or inability to call such a meeting, upon the call of the vice-chairman. SECTION 8-5. Director of Butte ,County Civil Disaster. Powers and duties. There is hereby created a position of Butte County Director of Civil Disaster. The director shall be the chairman of the BUttQ County Board of Supervisors. There is further created the position of Deputy Director, Butte County Civil Disaster. The in- dividual so selected shall be responsible to the County Adminis- trative Officer for the day-to-day management of the Civil Disaster program. The Director is hereby empowered: A. To request the Board of Supervisors to proclaim the existence of a disaster and the termination thereof. If the Board of Supervisors is not in session, the Director may issue such pro- clamation subject to confirmation by the Board of Supervisors at the earliest practicable time. B. With the approval of the Civil Disaster Council, to request the Governor to proclaim a state of extreme emergency when, 31. in the opinion of the council, the resources of the area or region ~ 32 are inadequate to cope with the disaster; 1 C. T_o contr.ol and direct civil disaster activities and 2 efforts for the accomplishment of the purposes of this ordinance; 3 D. To direct coordination and cooperation between divi- ~ sions, services, and staff of the civil disaster organization, 6 and to resolve questions of authority and responsibility that may 6 arise bet5~reen them; . 7 E. To represent tine civil disaster organization in all g dealings with public or private agencies pertaining to civil g defense and disaster; . 10 F. To appoint service chiefs subject to the approval of 11 the Civil Disaster Council; provided, however, the service chiefs 12 so appointed shall, insofar as possible, be employees who hold 13 regular administrative positions with appropriate governmental 1~ agencies. 15 G. Prescribe in writing the duties of any assistants pro- . ~,g vided him and the duties of chiefs or services, in conforming witY~ 17 the Butte County civil disaster pT.an. Such duties may be changed lg fro~p time to time by the Director, particularly for the purpose of lg conforming to recommendations of the Director of the California 2p Disaster Office, or the Federal Office of Civil Defense; 21 ~H. The Deputy Director shall develop a civil disaster plan 22 and program £or-Butte County and shall have such other duties as 23 may be assigned. lei SECTION 8-6. Disaster and emergency po~aers of the director 25 In the event of the proclamation of a disaster as herein 26 provided, or the proclamation of a state of disaster by the 27 Governor or the Director of the California Disaster Office, the 2g director is hereby empowered: 2g A. B. To obtain vital supplies, equipment and such other properties found lacking and needed for the protection of life and property of the people, and may bind the county for the fair value thereof, and if required inmiediately to commandeer .the same for public use. C. To require emergency services of any county or city officer or employee, and to command the aid of as many citizens of the County of Butte as he thir~'~s necessary in the execution of his duties; such persons shall be entitled to all privileges, benefits; and immunities as are provided by state law for registered civil disaster worker volunteers. D. To requisition necessary ~ rsonnel or material of any county or city department or agency; E. To exercise complete authority over the county and to exercise all police power vested in the county by the Constitution and general laws. SECTTON 8-7. Deputy Director, Butte County Civil Disaster Operational Area. Powers and Duties. There is hereby created the position of Deputy Director ,. Butte County Civil Disaster i Operational Area. His powers and duties are: A. To coordinate the activities of all civil defense I services both in pre-disaster planning, during a disaster, and in post-disaster activities by functioning as the chief staff officer to the Director, Butte County Civil Disaster. B. To organize and develop the Butte County Area Civil Disaster Program. C. To carry out any of the duties delegated to him by the Director. D. To prepare a budget and to submit such budget to the Butte County Administrative Officer at the time specified. F. To prepare and maintain the basic civil defense plan for the Butte County Civil Disaster Operational Area, and to sub- mit such plan to the Disaster Counci]. for approval. Such plans shall be consistent with .the Sate and National Disaster Plans. G. To assist service chiefs in the preparation of service annexes, and to make recommendations thereon to the Disaster Council. H. To submit a Butte County Civil Defense Operational Area program paper annually and progress reports at least semi-annually to the California Disaster Office. I. To prepare and submit all civil defense reports required by the Civil Defense agencies of the Federal Government and the State of California. J. To review and approve or disapprove applications of the several jurisdictions within the Butte County Civil Defense Oper- ational Area participating in the Federal Contributions and Surplus Property programs, and to maintain inventories of such equipment. Those cities desiring to carry out their own programs in this regard shall do so. ' K. To develop civil defense plans and capabilities in such areas as are not normally a function of any particular department of the county or cities of Chico, Oroville, Gridley, or Biggs, and to make recommendations regarding such plans to the Disaster Council. L. To act as Secretary to the Disaster Council. SECTION 8-8. Civil disaster organization. All officers and employees of the County of Butte, together with those volunteer forces enrolled to aid them during-a disaster, and all groups, ,organizations, and persons, including persons commandeered under the provisions of Section 6 of the ordinance, who may by agreement :~' - 1 2 3 5 6 7 8 9 10 11 12 13 l~ 15 16 17 18 19 20 21 22 23 2~ 25 26 27 28 29 30 31 32 or operation of law, be charged with duties incident to the pro- I~ tection of life and property during such disaster, shall accept and discharge such duties and responsibilities in the Butte County Civil Disaster Organization as they may be assigned. . SUCTION 8-9. Divisions, services, and stafL of the Butte County Civil Disaster Organization: ~- The functions and duties of the Butte County Civil Disaster Organization shall be distributed among such divisions, services, and special staff as the Butte County Civil Disaster Council shall prescribe by resolution, subject to the approval of the Board of Supervisors and the City Councils. SECTION 8-10. Punishment of violation. It shall be a mis- demeanor, punishable by a fine of not to exceed FIVE HUNDRED and 00/100 ($500.00) DOLLARS, or by imprisonment for not to exceed six (5) months, or both, for any person during a disaster: A. Wilfully to obstruct, hinder, or delay any member of the Butte County Civil Disaster Organization in the enforcement of any lativful rule or regulation issued pursuant to this ordinance, or in the performance of any duty imposed upon him by virtue of this ordinance; B. To.ao any act forbidden by any lawful rules or regu- lations issued pursuant to this ordinance, if such act is of such a nature as to give, or be likely to give, assistance to the enemy, or to imperil the lives or property of inhabitants of the County of Butte, or to prevent, hinder, or delay the defense or protection thereof. , SECTION 8-11. Expense. The expense of the Civil Disaster program not oti-~erwise paid for by federal. and state atiencies shall., be borne by the county.
