AN ORDINANCE FOR THE PROTECTION OF THE FRUIT AND NUT GROWING INDUSTRY OF BUTTE COUNTY AGAINST SERIOUS INFECTIOUS OR TRANSMISSIBLE VIRUS DISEASES OF FRUIT AND NUT TREES AND PROVIDING FAR THE PROPER ENFORCEMENT AND PROSECUTION OF VIOLATORS THEREOF. _._.._. _._ The Board of Supervisors of the County of Butte, do ordain as follows: That Chapter 23 of the Code of the County of Butte, State of ' California, entitled "Trees and Shrubs" is amended by adding thereto Article III, Section 23-6, as follows: 1. It shall be unlawful for any person, firm, or corporation to knowingly maintain, cultivate or propagate any fruit or nut tree or other host plant infected with any serious virus disease within the County of Butte. 2. The term "serious virus disease" specifically includes the virus diseases referred to as the Yellow Leaf Roll of Peach, the 6~Iestern X Disease of Peach (also known as the Buckskin Disease of Cherries}, the Peach Mosaic Disease, the Peach Wart Disease, Yellow Bud Mosaic and any other as specified by the County Agricultural Commissioner or the Director of Agriculture. 3. The Agricultural Commissioner of Butte County shall, whenever he deems it necessary, cause an inspection to be made of fruit and nut trees for the presence of serious virus diseases and shall cause a suitable mark or tag to be placed on any plant found to be infected Urith any such serious virus disease and shall report the finding of such infection in writing to the owner or other person in charge of the property upon completior. of a positive determination of the disease. k. Any person, firm, corporation or associatian of individuals who knowingly grows, maintains or propagates any fruit or nut tree or ather host plant infected with any such serious virus disease for a period of more than seven days after written notification of such infection by the ,,County Agricultural Gommissioner shall be guilty of a misdemeanor, and upon conviction, shall be punished by confinement in the county jail for a period ,;;.not,;; to exceed six (6) months or by a fine not to exceed Five Hundred 1 2 3 4 5 6, 7 8 9 10 11 12 13 14 15 16 17 18 19 2d 21 22 23 24 25 26 27 28 29 30 31 32 ($500.00) Dollars,. or by both such fine and imprisonment. 5. If the infected plant has not been treated or destroyed within the seven (7) day notification period, it shall be the duty of the Agricultural Commissioner to treat or destroy the infected plant. 6. All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. 7. That this ordinance shall take effect thirty (30) days after the date of its adoption, and before the expiration of fifteen (15) days after its passage, it shall be published with the names of the members voting for and against the same, once, in a newspaper published in the County of Butte, State of California.
