RESOLUTION APPROVING THE RESCINDING OF THE
CONGESTION MANAGEMENT PROGRAI~~1 AS A
STATE TRANSPORTATION PLANNING REQUIREMENT FOR THE
COUNTY OF BUTTE AND THE INCORPORATED MUNICIPALITIES
WHEREAS, in 1990 the voters of California adopted Proposition 1 1 1 which amongst other
things required that all counties with an urbanized area designate a Congestion Management Agency
to prepare a Congestion Management Program for the county and cities; and
WHEREAS, in 1991 the County of Butte and the incorporated municipalities within Butte
County designated the Butte County Association of Governments (BCAG) as the Congestion
Management Agency far Butte County with the responsibility to prepare and update the Congestion
Management Program far the incorporated municipalities and the County; and
WHEREAS, BCAG has prepared and updated the Congestion Management Program for the
County and incorporated municipalities on a biennial basis in accordance with California
Government Code 65089 since 1992; and
WHEREAS, in 1996 AB 2419 was signed into law a]lowing urbanized counties to rescind
the requirements of the Congestion Management Program within the county when a majority of the
local gaverm~~ents representing a majority of the population of the county adopt resolutions to that
effect; and
WHEREAS, an November 21, 1996, BCAG as the Congestion Management Agency fal~
Butte County voted unanimously to support rescinding the Congestion Management Program
requirements for the County and incorporated municipalities, and requested that resolutions be
adopted by the necessary local governments;
NOW, 'T'HEREFORE, BE IT RESOLVED that the Board of Supervisors does hereby
approve the rescinding of the Congestion Management Program requirements far the County of
Butte.
PASSED AND ADOPTED by the Butte County Board of Supervisors this 2.5th day of
March ] )97 by the following vote:
AYES: Supervisors Beeler, Dolan, Houx, Josiassen and Chair Davis
