HomeMy WebLinkAbout97-041WHEREAS, Resolution 75- l 77 was passed on December 9, 1975, regarding the treatment of cash shortages which are not the result of fraud and gross negligence; and WHEREAS, said Resolution was consistent with procedures and requirements of Government Code Section 29390 as existed at that time; and WHEREAS, in 1991 the State 1_egislature of the State of California modified Government Code Section 29390 to be no longer consistent with Resolution 75-177 and to simplify Relief from Accountability procedures in the absence of fraud and dross negligence; and WHEREAS, the Auditor - Control]er and District Attorney of the County of Butte are satisfied that Government Code Section 29390, as modified, offers sufficient safeguards for the protection of public funds. NOW, THEREFORE, BE IT RESOLVED by this Board Resolution 75-177 is hereby rescinded; and BE IT FURTHER RESOLVED by this Board that procedures to be followed by the Auditor - Controller of the County of Butte and this Board of Supervisors be those as defined and provided for in Government Code Section 29390. PASSED AND ADOPTED by the Butte County Board of Supervisors this 8th day of April, 1997, by the following vote: AYES: Supervisors Beeler, Dolan, Houh, Josiassen and Chair Davis NOES: None ABSENT: None ~~.
