~~~ ~~ yS UP.~~'~i ..~~ raaar^nu^~~a~'~~~~1 ~y • 'n ~ Q+ rs © • ~ 0 • ~ ~ :M: ~^ 1+~ . ~* + *i BOARD OR SUPERVISORS COUNTY OF BUTTE, STATE OF CALIFORNIA I~~~sc~lufion No. 97-56 RESOLUTION REIMPOSING EXISTING COUNTY SERVICE CHARGES FOR FISCAL YEAR 1997-98 WHEREAS, Government Code Section 25210.77a contains authority for the County of Butte to fix and collect service charges for a particular extended service provided through a county service area or zone; WHEREAS, the Board of Supervisors did, by ordinance adapt Butte County Code Section 21-85 et seq., establishing a procedure for annually levying and collecting such charges on the tax roll; WHEREAS, these procedures provide that such action taken in accordance with said ordinance shall be confirmed by resolution of the Board of Supervisors; VVf-IEREAS, on September 10, 1996 this Board adopted Resolution 96-107 levying service charges for various County Service Areas listed therein, in the amounts set forth in Exhibit A attached hereto; WHEREAS, on September 12, 1995 this Board adopted Resolution 95-126 levying a service charge for County Service Area 31 in the amount of $15.1.6 but due to unanticipated savings and the resulting fund balance carryovers the amount of the service charge levied for 1996-97 was reduced; WHEREAS, on September 13, 1994 this Board adopted Resolution 94-1071evying a service charge for County Service Area 34 in the amount of $4.86 but due to unanticipated savings and the resulting fund balance carryovers the amount of the service charge levied far 1996-91 was reduced; WHEREAS, this Board finds and declares that County Service Areas 31 and 34 are special benefit districts, geographically distinct within the County of Butte and providing extended services therein not generally available to the public at large in the rest of the County; WHEREAS, the amount specified as the service charge for County Service Area 164 (Animal Control) was the amount approved by a majority of the voters at the election held on November 8, 1994, at which election the voters were asked the question "Should proceedings be instituted to establish a County Service Area to provide animal control services and to levy a service charge therefor, said service charge not to exceed $5.00 annually per parcel of real property?"; WHEREAS, a written report identifying each parcel of real property receiving a particular extended service, and the amount of the proposed charge for each parcel for 1997-1998, has been filed with the Clerk of the Board of Supervisors and resides in the Property Tax Section of the Auditor's Office; WHEREAS, on March 25, 1997, this Board adopted Resolution 97-40 determining certain County Service Area charges to be "existing fees" and setting a public hearing to consider levying service charges in the various County Service Areas for fiscal year 1997-98 in an amount not exceeding the existing amount; WHEREAS, notice having been duly given by the Clerk of the Board by publishing notice as provided in Government Code Section 6066, and a public hearing having been held on April 22, 1997, to consider levying such existing service charges for fiscal year 1997-98 in accordance with the procedures specified in Government Code Section 25210.77a and Article VI of Chapter 21 of the Butte County Code (commencing with Section 21-85) , to hear and consider all objections or protests, if any, and to adopt, revise, change, reduce or modify any charge as described in the report and thereafter, by resolution, to confirm the report and levy the service charges for each County Service Area in an amount not exceeding the amount determined to be the existing amount; WHEREAS, information pertaining to the proposed budgets of the affected County Service Areas was submitted to and considered by this Board at the public hearings held on April 8 and 22, 1997; 2 and WHEREAS, the Board of Supervisors has made the determination upon each charge as described in the report required by Government Code Section 25210.77a for the fiscal year 1997-98. NOW, THEREFORE, BE IT RESOLVED, 1. The written report identifying each parcel of real property receiving a particular extended service, and the amount of the proposed charge for each parcel for 1997-1998, filed with the Clerk of the Board of Supervisors and residing in the Property Tax Section of the Auditor's Office, is hereby confirmed. 2. The existing service charges established by Resolution 46-107 for the various County Service Areas for fiscal year 1996-97, as set forth on Exhibit A attached hereto, are hereby reimposed for fiscal year 1997-98. 3. The existing service charge established by Resolution 95-126 for County Service Area 31 for fiscal year 1995-96 in the amount of $15.16 per parcel is hereby reimposed for fiscal year 1997-98 in said County Service Area. 4. The existing service charge established by Resolution 94-10? for County Service Area 34 for fiscal year 1994-95 in the amount of $4.86 per parcel is hereby reimposed for fiscal year 1997-98. 5. The existing service charge established by Resolution 96-107 for County Service Area 164 for fiscal year 1996-97 in the amount of $5.00 per parcel is hereby reimposed for fiscal year 1997-98. 6. The Auditor is directed to place the said service charges on the 1997-98 tax bills as separate items. Provided, however, that if the final budget adopted for any affected County Service Area is less than the proposed budget upon which the charges were based or the fund carryover is greater, then the auditor is directed to make a corresponding reduction in the service charges to be placed on the tax bills. 7. It is found that each of the fees imposed by this Resolution: do not exceed the cost of the services to be provided in each of the respective County Service Areas or zones of benefit; are to be used only for the purpose of providing the extended services in each of the respective County Service Areas or zones; do not exceed the proportional cost of the extended services to be provided to each affected parcel of real property, and are for extended services which are used by or immediately available to the owner of each such affected parcel of real property.
