HomeMy WebLinkAbout97-070.~'~~3c ~S U •.~'~~'i `.i A`•`.*t ~~ n n ~~~~~r ii °~'~ ..'~~ B ARD F S PERVISOR~ ~ , >~n, CJ tJ U ** ~ ' *~ COUNTY OF BUTTE, STATE OF CALIFORNIA 'CSA ' •~tiT ~~+~ ~~~~~~~ ~~'solufion t~~c~. 97-7U ~~:1~~~~~~~~ RESOLUTION AMENDING RESOLUTION 97-57 AS IT RELATES TO CSA 135 ZONES 2 AND 3 AND DIRECTING COMMENCEMENT OF PROCEDURES TO IMPOSE REVISED NEW/ INCREMENTAL SERVICE CHARGES IN COUNTY SERVICE AREA ZONES 2 AND 4 AND SETTING PUBLIC HEARING TO CONSIDER LEVYING SUCH NEWIINCREMENTAL CHARGES FOR FISCAL YEAR 1997-98 WHEREAS, Government Code Section 25210.77a contains authority for the County of Butte to fix and collect service charges for a particular extended service provided through a county service area or zone; and tiVHEREAS, the Board of Supervisors did, by ordinance adopt Butte County Code Section 21-85 et seq., establishing a procedure for annually levying and collecting such charges on the tax roll; and WHEREAS, Article XIII D, Section 6 of the California Constitution, as adopted by passage of Proposition 2l 8 on November 5, 1996, established procedures for levying new charges; and WHEREAS, a written report identifying each parcel of real property receiving a particular extended service, and the amount of the new/incremental charge for each parcel for 1997-1998, has been filed with the Clerk of the Board of Supervisors and resides in the Property Tax Section of the Auditor's Office; and WHEREAS, the Board previously gave notice of and to held a public hearing on April 22, 1997, to consider levying such new/incremental service charges for fiscal year 1997-98 in accordance with the procedures specified in Article XIII D, Section 6, of the California Constitution, and after such hearing adopted Resolution 97-5? imposing new/incremental service charges in specified County Service Areas for fiscal year 199?-98, subject to approval by a majority vote of the owners of the property within each such County Service Area subject to the charges; WHEREAS, after adoption of Resolution 97-57 this Board learned that the amount of the newlincremental services charges specified therein for CSA 135 Zones 2 and 3 were not in an amount sufficient to provide the needed services therein; WHEREAS, the Board wisnes to amend Resolution 97-57 by repealing the provisions therein relating to CSA 135 Zones 2 and 3 and to commence procedures to impose new/incremental service charges in Zones 2 and 3, noting that Zone 3 has been re-designated as Zone 4. WHEREAS, the Board wishes to give notice of and to hold a public hearing to consider levying such incremental service charges for fiscal year 1997-98 in accordance with the procedures specified in Article XIII D, Section 6, of the California Constitution, in CSA 135 Zones 2 and 4, in the amounts of $210.78 and $202.80, respectively. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. Resolution 97-57 is amended by repealing the provisions therein relating to CSA 135 Zones 2 and 3. 2. Procedures shall be commenced to impose new/incremental service charges in Zones 2 and 3, noting that Zone 3 has been re-designated as Zone 4 3. A public hearing is set for July 22 , 1997, at 10 : OOa.m. pursuant to Article 7 Chapter 2.2, title ,Division 2 of the Government Code (commencing with Section 25210.70), Article VI of Chapter 21 of the Butte County Code (commencing with Section 21-85} to hear and consider all objections or protests, if any, and to adopt, revise, change, reduce or modify any charge as described in the report and thereafter, by resolution, to levy the new/incremental charges in CSA 135 Zones 2 and 4, in an amount not exceeding $210.78 and $202.80, respectively, per parcel of real property. 2. The Clerk of the Board of Supervisors is directed to publish notice of said hearing as required by Butte County Code Section 21-88 and, with the assistance of the Elections Department, Public Works Department, Auditor-Controller and the Assessor, to provide written notice thereof by mail to the record owner of each identified parcel upon which the new/incremental charge is proposed for levying. Said written notice shall include the amount of the proposed newlincremental charge, the basis upon which the amount of the proposed new/incremental charge was calculated, the reason for the new/incremental charge, and the date, time and location of the public hearing, and shall state that the record owner may submit a written protest against the newlincremental charge to the Clerk prior to or during the hearing.
