AS IT RELATES TO CSA 1 TO DESCRIBE ZONES 1 (UNDO MANOR) AND 2 (AZALEA ACRES) AND TO SPECIFY THAT THERE WILL BE NO NEW OR INCREMENTAL CHARGE AND NO ELECTION IN ZONE 2 WHEREAS, Government Code Section 25210.77a contains authority for the County of Butte to fix and collect service charges far a particular extended service provided through a county service area or zone; and WHEREAS, the Board of Supervisors did, by ordinance adopt Butte County Code Section 21-85 et seq., establishing a procedure for annually levying and collecting such charges on the tax roll; and WHEREAS, Article XIII D, Section 6 of the California Constitution, as adopted by passage of Proposition 218 on November 5, 1996, established procedures for levying new charges; and WHEREAS, a written report identifying each parcel of real property receiving a particular extended service, and the amount of the newlincremental charge for each parcel for 1997-1998, has been filed with the Clerk of the Board of Supervisors and resides in the Property Tax Section of the Auditor's Office; and WHEREAS, the Board previously gave notice of and to held a public hearing on April 22, 1997, to consider levying such newlincremental service charges for fiscal year 1997-98 in accordance with the procedures specified in Article XIII D, Section 6, of the California Constitution, and after such hearing adopted Resolution 97-57 imposing newlincremental service charges in specified County Service Areas for fiscal year 1997-98, subject to approval by a majority vote of the owners of the property within each such County Service Area subject to the charges; WHEREAS, after adoption of Resolution 97-57 this Board learned that the new/incremental services charges specified therein for CSA 1 should not be imposed on properties within Azalea Acres Subdivision because that area will not benefit from the services to which said charges relate. WHEREAS, the Board wishes to amend Resolution 97-57 to describe CSA 1, Zone 1, as Linda Manor Subdivision, and CSA 1, Zone 2, as Azalea Acres Subdivision, and to specify that there will be no new or incremental charge and no election pertaining to such a charge in Zone 2. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. CSA 1, Zone 1, is hereby established and is described as all that area within the Lindo Manor Subdivision. 2. CSA 1, Zone 2, is hereby established and is described as all that area within the Azalea Acres Subdivision. 3. Resolution 97-57 is amended to specify that the $14.44 amount of the new or incremental charge, identified therein as the "Amount Imposed Above Existing Charge-Subject to Election", shall apply only to CSA 1, Zane 1. 4. There will be no new or incremental charge and no election in CSA I, Zone 2, pertaining to service charges for Fiscal Year 1997-98.
