HomeMy WebLinkAbout971l~ The Board of Supervisors of the County of Butte, State of Cali- fornia, under and pursuant to Ordinance No. 475 of said County, being the Zoning Enabling Ordinance of said County as amended by Ordinance Nos. 522 and 676, DO ORDAIN as follows: AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, PURSUANT TO ORDINANCE NOS. 475, 522 and 676. OF SAID COUNTY- ORDINANCE NO. 971 SECTION 1. The hereinafter described area situate in the County of Butte, State of California, shall be and is hereby zoned as an "M-2" (Heavy Industrial)_.Distri~t.as.hereinafter described and .subject to all the restricted uses applicable to the uses of an "M-2" Dis- trict. Said area so zoned being located in the unincorporated area of Butte County, particularly described as follows: 8 9 10 ll'. 124 13 14 15 16' 17 18' 19 20 21 22', 23` 24 2S: 26' 27 2$ 29 30 31 32 1.1 That portion of AP 40-02-03 located west of Skyway and north of Butte Creek, as shown by map attached and as-shown in the office of the Butte County Planning Commission and in the office of the Butte County Clerk. 1.2 AP 40-02-51 located west of Skyway and south of Butte Creek, as shown in the office of Butte County Planning Commission and in the office of Butte County-Clerk. SECTION 2. REGULATIONS FOR AN "M-2" District: 2.1 USES PERMITTED: a. Any uses permitted in C-1, C-2 and M-1 Districts. b. Aircraft factories, manufacturing of asbestos, assaying, boiler works, breweries and distilleries, candle manu- facturing, carbon manufacturing, cellulose materials manufactur- ing, chain and cable manufacturing, disinfectants manufacturing, dry kilns, emery cloth and sandpaper manufacturing, enameling, feed and cereal mills, foundries, freight .terminals, galvanizing and lead plating, glass or glass product manufacturing, lamp black manufacturing, machinezy manufacturing, soda and cleaning compound manufacturing, match manufacturing, metal fabrication, nil cloth or .linoleum manufacturing, oxygen manufacturing, paint manufacturing, paper box manufacturing, petroleum distributing stations (wholesale for retail), plywood manufacturing, printing ink manufacturing, railroad yards or roundhouses, rope manufacturing, soap and soap compound. manufacturing, starch,. glucose or dextrine manufacturing, vegetable oil manufacturing, welding shops .and sheet metal shops, wood•.;.p.laning.mill,.ar wood working plants, yeast. plants and other similar industrial enterprises or. businesses .in character to those enumerated, when interpreted as similar by the Planning Commission. c. Canneries, olive processing plants and other agricultural processing plants of similar nature. d. Accessory uses and buildings permitted pertinent to any.; permitted use. 2.2 MTNTMUM SETBACK REQUIRED: Fifty (50} feet from the centerline of the road, except where-the road is classified as a Federal Aid Secondary and then th minimum setback shall be fifty-five {55) feet from the centerline jof said road. 1 2.3 BUILDING SITE AREA REQUIREMENTS: None, except as may be required for building and for off- 2 street loading area and parking space as set forth below under 'Truck Loading and "Unloading Space.. 3 2.9 SIDE YARD REQUIREMENT: 4 The minimum side yard shall not be less than five (5) feet. 5 2.5 REAR YARD REQUIREMENT: The minimum rear yard shall not be .less than five (5) 6 feet. 2.6 OFF-STREET PARKING REQUIRED: ~, One parking space for each three (3) employees, or one parking space for each two thousand (2,000) square feet of gross $ floor space, whichever is greater.. 9 2.7 TRUCK LOADING AND UNLOADING SPACE: Private off-street loading .space for the handling of all 10 goods, materials and equipment shall be provided. Such space shall be of sufficient area and of such design as to permit the parking 11 and loading of vehicles without extending into any existing street beyond the curb line. 12 2.$ THE FOLLOin7rNG USES SUBJECT TO THE SECURING OF A USE PER-_ 13 :MIT TN EACH CASE: a. Any residential dwelling or use. 14 b. Commercial distillation of bones, abatoirs, auction yards, commercial livestock feed yards, commercial millings, 15 canneries, lumber and lumber processing, tanneries, fat rendering, garbage fed commercial hog raising, food and agriculture product lg processing plants. c. Storage of inflammables. lq 8. Commercial or public dumping and disposal areas. e. Manufacturing of acids, explosives, fertilizer, glue lg gypsum, lime, plaster of Paris, pulp and paper, beet sugar; crushed rock, sand and gravel, cement, concrete and/or asphalt botching 19 plants, concrete and clay products. f. Industrial us=es-which might be objectionable Say 20 reason of emission of noise, offensive odor.. smoke, dust, bright light, vibration or involving the handling of explosives or danger- 21 ou materials. g. Junk yards and auto wrecking yards. 22 SECTION 3. 23 All uses of land within the district not specifically authorized 24 and permitted under Section 2, are prohibited. 25 SECTION 4. 26 Penalty for any violation of the zoning hereby proposed within the district shall be as provided in the Zoning Enabling Ordinance 27 and in compliance with the provisions of the Zoning Enabling Ordinance, this Ordinance shall from and after its effective date 28 become a supplement to and part of the Zoning Enabling Ordinance. 29 SECTION 5. 30 In compliance with the provisions of said Zoning Enabling Ordinance, thy, same .s hereby amended by adding. to Section 5 there- 31 of this Ordinance in full. 32 .. _2_ 1' 2' 3~ 4' 5' 6', 'Y 81 9i 10 11 '' 12' 13 14 15 ': ]6 1'7 '' 18 19 20' 2L 22 23' 24. 2B' 26 27' 28' 29' 30' 31! 32. SECTION 6. This Ordinance shall be and is hereby declared to be in full force and effect from and after thirty (30) days after the date of its passage, .and before the expiration of fifteen (15) days after its passage, this Ordinance shall be published once with the names of the members of the Board voting for and against it in the Chico Enterprise , a newspaper published in the County of Butte, State of California.
