HomeMy WebLinkAbout97-142~o~a a~~ ~~uP~~viso~s COUNTY OF BUTfE, STATE OF CALIFORNIA Resolution No. 97-142 RESOLUTION REGARDING IMPOSITION OF NEWlINCREMENTAL SERVICE CHARGES IN COUNTY SERVICE AREAS 90 ZONE 1, 101, 135 ZONES 2 AND 4, AND 165 FOR FISCAL YEAR 1997-98 WI-IEREAS, on April 29, 1997, the Board of Supervisors adopted Resolution 97-57 imposing newt incremental service charges in various County Service Areas ("CSAs"), including CSA 90 Zone 1, CSA 101 and CSA 165, subject to approval by a majority vote of the owners of the property within each such CSA or Zone on June 24, 1997; and WHEREAS, the Butte County Clerk-Recorder has certified that a majority of the votes cast regarding the service charges in CSA 90 Zone 1, CSA 101 and CSA 165 were "Yes" and that a majority of the votes cast regarding the service charges in the various other CSAs were "No"; and WHEREAS, on August 12, 1997 the Board held said hearing and, at the conclusion thereof, adopted Resolution 97-105 imposing new sewer service charges in CSA 135, Zone 4, and imposing incremental service charges in CSA 135, Zone 2, subject to approval by a majority vote of the owners of the property within Zane 2, on September 30, 1997; and WHEREAS, the Butte County Clerk-Recorder has certified that a majority of the votes cast regarding the service charges in CSA. 135, Zone 2, were "Yes". NOW, THEREFORE, BE IT RESOLVED, i . That the following newlincremental service charges, per each parcel of real property, have been approved by the property owners in each respective CSA or Zone and shall be imposed for fiscal year 1997-98: CSA 90, Zone 1: $ 20.00 CSA ]Ol: 54.00 1 CSA 135, Zone 2: 1~'" 94 CSA 165: 7,482.00 2. That the new/incremental service charges in the other CSAs involved in these proceedings, as listed below, have not been approved by the property owners and will not be imposed as a part of these proceedings: CSA 1 Zone 1, 76, 90 Zone 2, 94, 97, ]00, 128, l35 Zone 1, and 163. 3. As to those new/incremental charges which are approved, the Board directs the Auditor to place the charges on the 1997-98 tax bills. Provided, however, that if the final budget adopted for any affected County Service Area or Zone thereof is less than the proposed budget upon which the charges were based or the fund carryover is greater, then the Auditor is directed to make a corresponding reduction in the new/ incremental service charges to be placed on the tax bills. 4. It is found that each of the fees imposed by this Resolution: do not exceed the cost of the services to be provided in each of the respective County Service Areas or Zones thereof; are to be used only for the purpose of providing the extended services in each of the respective County Service Areas or Zones; do not exceed the proportional cost of the extended services to be provided to each affected parcel of real property; and are for extended services which are used by or immediately available to the owner of each such affected parcel of real property.
