Bt.tT~F~, STATE QF CA~.lFO~tNlA ~lE'SO111f10t1 NU. 97-158 A RESOLUTION OF THE BOARD OF SUPERVISORS OF BUTTE COUNTY APPROVING THE SITING ELEMENT AND SUMMARY PLAN OF THE BUTTE COUNTY INTEGRATED WASTE MANAGEMENT PLAN WHEREAS, the County of Butte recognizes that it is in the public interest to enact and implement an integrated waste management plan to address the State's diminishing landfill capacity and the potential adverse environmental impacts from landfilling; and WHEREAS, as part of its plan to conserve landfll capacity and address potential environmental impacts from landtilling, the Board of Supervisors of the County of Butte adopted the Source Reduction and Recycling Element and Household Hazardous Waste Element on November 10, 1992, and the Non Disposal Facility Element on November 22, 1994, which Elements will be included in the Butte County Summary Plan of the County Integrated Waste Management Plan: and WI-{EREAS, the County of Butte has prepared the Siting Elementand Summary Plan of the Butte County Integrated Waste Management Plan in accord with the mandates set forth by Assembly Bill 939, the California Integrated Waste Management Act of 1989 (Division 30 of the Public Resource Code, commcncin~~ with Section 40000); and W] IEREAS, at its meeting of September I I. 1996, the Butte County Integrated Waste Management Local Task Force considered the Final Draft Siting Element and Summary Plan of the Butte Ct~unty Integrated Waste Management Plan and unanimously passed a motion to accept the Elements and distribute them for consideration by the City and '('own Councils and Board of Supervisors; and WHEREAS, the County of Butte may approve or disapprove the proposed Siting Element and Summary Plan of the Butte County Integrated Waste Management Plan pursuant to Public Resources Code Section 41760; and 1w'HERLAS, a majority of the Cities with a majority of the population in the incorporated portion of the County must approve of the Sitin~~ Element and Summary Plan of the Butte County Integrated Waste Management Plan for it to be approved by the California Inte~~rated Waste Mana~~ement Board; and WHEREAS, the County of butte cun-ently has a minimmn estimate of 18 years of solid waste disposal capacity available through the Neal Road Landfill and the State required threshold for planning new or expanded solid waste disposal facilities is 15 vears of capacity: and WEIEREAS, Butte Co~~mty is not proposing new or expanded solid waste disposal facilities in the Countywide Siting Element and Summary Plan; and WHEREAS, the Board of Supervisors has held a public hearing and considered pi~lblic comments on the Siting Element and Summary Plan of the County Integrated Waste Management Plan; NO1'~~, ~fHERLFORE, BF_ 1T RESOLVED pursuant to Public Resources Code Section 41760, that the Butte County Board of Supervisors makes the following findin~~s: A. An initial study has been conducted to evaluate the potential for signiticant adverse environmental effects. There is no substantial evidence in light ofthe whole record that the prgject may have a significant effect on the environment. B. A Negative Declaration has been prepared pursuant to the California Environmental Quality Act {CE(~A). "I'he Negative Declaration has been considered with other agency comments and retlects the independent judgment of the Board of Supervisors. The enviromnental doeutnentation is available for public review at the Butte County Department of [ ~~iblic Works. NOTICE IS F{EREBY GIVEN that the project described below has been reviewed pursuant to the provisions of the California Environmental Quality Act of 1970 (Public Resource Code 21100, et. seq.) and a determination has been made that it will not have a significant effect upon the environment. 2. DESCRIPTION OF PROJECT: Preparation and adoption of the Countywide Siting Element and Summary Plan of the Butte County Integrated Waste Management Plan. The project consists of the Siting Element and Summary Plan prepared to meet the requirements of the California Integrated Waste Management Act of 1989 (AB 939) and California Code of Regulations (CCR) Title 14, Sections 18755 - 18756.7 and 18755 - 18758. 3. A copy of the Initial Study regarding the environmental effect of this project is on file in the Department of Public Works at 7 County Center Drive, Oroville, CA 95965. A public hearing on this Negative Declaration was held by the decision making body. We find that the project COULD have a significant effect on the environment, but will not in this case because of attached mitigation measures described in item S above, which are by this reference made conditions of project approval.
