WHEREAS, California Welfare and institutions Code, section 17000 et. seq., requires that each and every county relieve and support all incompetent, poor, indigent persons, and those incapacitated by age, disease or accident, lawfully resident therein, when such persons are not supported and relieved by their relatives or friends, or by their own means, or by state hospitals or other state or private institutions; and WHEREAS, Butte County has had in place for many years a program known as the "General Assistance" program and has maintained an eligibility manual known as the "G.A. Manual", which contains county regulations dealing with eligibility standards, grant levels, method of payment and applicant responsibilities in dealing with the program, among others; and WHEREAS, since the last amendments to tine G.A. Manual, there has been significant State and Federal legislation, which effects the provision of General Assistance to residents of Butte County, including but riot limited to, the adoption of Federal Law P.L. 104-121 and AB 1542 ;CaIWORKs); and WHEREAS, it is prudent and necessary to further amend the General Assistance Manual to reflect changes necessitated by these recent Legislative enactments; NOW, THEREFORE, IT IS HEREBY RESOLVED as follows: That the General Assistance Manual, originally adopted by the Board of Supervisors in August 1957 and revised from time to time, the last revision having occurred in November of 1996, be further revised and amended effective January 1, 1998 as follows: 1 . Section 1 , Article 3!C)(2)(e) be added, clarifying language which allows households to provide verification from a reliable source if the value placed an the vehicle using the Department of Motor Vehicle Chart is disputed. 2. Article 6 be amended to add clarifying language, pursuant to Federal Law P.L. 104-121, regarding the definition of are errrployable person to include those individuals whose only verified disability is due to drug addiction andlor alcoholism. 3. Article 6, adding clarifying language that persons restricted to part-time work are considered ernployabie if, the number of hours trey are able to work multiplied by current minimum wage exceeds the maximum G.A. grant for one person. 4. Article 7, adding language identifying the CA 61 Medical Report form be sent to a doctor to verify the applicant recipient's alleged disability. Article 11.(C}(1-, adding regulations pursuant to authority granted in AB 1542 that adult recipients of CaIWORKs program who reach the 60 month lifetime limit may be eligible for G.A. only when all children in the household are '1$ years of age or older. 6. Article 11.(D)(1-5), adding regulations pursuant to authority granted in AB 1542 prohibiting individuals from receiving General Assistance if they have been penalized or sanctioned from the CaIWORKs program. 7. Article 11 .(G), adding regulations pursuart to authority granted in AB1542 prohibiting fleeing felons from receiving General Assistance. $. Article 11.(I-I), adding regulations pursuant to authority granted in AB 1542 prohibiting persons in violation of their probation or parole from receiving General Assistance.
