STAT~ C~~ G`~AiL11F'4l~NIA ~~~~ Q~u1,~~~~ c.c'S~~~ltft~~i, ~'~i~t~. 97-174 RESOLUTION DISSOLVING COUNTY SERVICE AREA NO. 84 (CANYON PARK ESTATES SEWER DISTRICT) AND ITS SPHERE OF INFLUENCE WHEREAS, the Butte Gounty Department of Public Works, Land Development Division, has requested the Butte County Local Agency Formation Commission dissolve County Service Area No. 84 (Canyon Park Estates Sewer District) and its co-terminus Sphere of Influence in accordance with the Cortese-Knox Local Government Reorganization Act of 1985, as set forth in Division 3, Title 5 of the California Government Gade; and WHEREAS, on September 4, 1997, the Butte County Local Agency Formation Commission adopted and passed Resolution No. 97-37 making determinations and approving the proposed dissolution of County Service Area No. 84 and its co-terminus Sphere of Influence; and WHEREAS, the Butte County Local Agency Formation Commission has made the finding that this project is a General Rule Exemption under the California Environmental Quality Act per Section 15061. A Notice of Exemption was filed with the Butte County Clerk on September 16, 1997; and WHEREAS, the reason for the proposed dissolution of County Service Area No. 84 is that the County Service Area was formed to provide sewerage facility maintenance for a Specific Plan which was approved by the Board of Supervisors. Said Specific Plan was challenged by residents within the Chico area. The decision of the Butte County Superior Court set aside the Specific Plan, resulting in no need to retain the County Service Area. The Board of Supervisors adopted Resolution No. 93-144 on September 2$, 1993 that rescinded Resolution 82-63 for the Canyon Park Estates II Specific Plan. The corporate powers of said County Service Area have not been used and there is a reasonable probability that they will not be used in the future. Services or facilities of substantial benefit have not been provided to the residents or landowners of said County Service Area; and NOW, THEREFORE, BE IT RESOLVED by the Butte County Board of Supervisors as follows: 1. Said Board hereby finds and determines that the proceedings herein were conducted pursuant to Chapter 2.2 of Part 2 of Division 2 of Title 3 of the Government Code (commencing with Section 25210.1), and in particular with Article 3 thereof {commencing with Section 25210.30), and with Part 4 of Division 3 of Title 5 of the Government Code {commencing with Section 57000). 2. Said Board hereby finds and determines that the corporate powers of County Service Area No. 84 have not been used and there is a reasonable probability that they will not be used in the future. Therefore, the dissolution of County Service Area No. 84 shall be dissolved without an election pursuant to Government Code Section 57083. 3. County Service Area No. 84 (Canyon Park Estates Sewer District) and its co- terminus Sphere of Influence is hereby dissolved. The boundaries of said County Service Area No. 84 are described in Exhibit "A" attached hereto and made a part hereof by this reference. 4. The property shall remain in County Service Area No. 164 (Butte County Animal Control District). 5. The short form designation of these proceedings is: 97-31 -Dissolution of County Service Area No. 84 (Canyon Park Estates Sewer District) and its Sphere of Influence. 6. The Clerk of the Board is authorized and directed to file a certified copy of this Resolution with the Executive Officer of the Butte County Local Agency Formation Commission.
