HomeMy WebLinkAbout976ORDINANCE NO. ~ ~ f4 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, PURSUANT TO ORDINANCE NOS. 475, 522 and 676 OF SAID COUNTY AND AMENDING ORDINANCE NO. 840 OF SAID COUNTY 6 7 8 9 10 11 12' 13 14 15 16 17 18 19 20 21 22 23 24 2S 2B 27 28 29- 30 31 32 The Board of Supervisors of the County of Butte, State of California, under and pursuant to Ordinance No. 475 of said County as amended by Ordinance Nps. 522' and 676, and amending Ordinance No. 840 of said County, Do Ordain as folloias: SECTION 1. The hereinafter described area situate in the County of Butte, State of California, shall be and is hereby zoned as a~7,`~!'N--C" (iVei~hbox~hggd' Commercial)) District, hereafter described and subject to all of tiie res~Erict~ct uses applicable to the uses of an "N-~~' District, said area so zoned being located east of the City of Chico, particularly described as follows: As shown by map attached AP 45-33-69 and as shown an Butte,.County Sectional Map 2H as shown in the office of the Butte County Planning Commission and in the office of the Butte County Clerk. SECTION 2. The following restrictions shall apply in an "N-C" (Neighborhood Commercial) District: 2.1 Uses permitted shall be limited to the following: a. Single family dwellings, duplexes and apartments, subject to the building site area, lot width and yard req- uirement specified for the residential districts. b, Grocery stores, drug stores,. barber shops, beauty shops, self service laundry and laundry pick up services. 2.2 Off Street Parking requirements: The area for off street parking shall be not less than two (2) square feet for each square foot of gross floor space. 2.3 Other Requirements: a. Copies of the site plan for the development shall be submitted and approved by the Public Works Department, Health Department and the Planning Cammission. b. On any boundary line which is a common property line with property classified for uses in the "R" category, a wall or view-obscuring fence not less than five (5) feet or more than six (6} feet in height shall be installed and maintained for screening purposes and controlling trespass, except where the wall of a building is on such common property line no separate wall or fence need be installed along the portion of the property line occupied by the wall of the building. c. All building and structures shall not be closer than fifty (50) feet from the centerline of the street. SECTION 3. All uses of land within the District not specifically authorized and permitted under Section 2 are prohibited. SECTION 4. Penalties for any violation within the District shall be as provided in the Zoning Enabling Ordinance. In compliance with the provisions of the Zoning Enabling Ordinance, this Ordinance shall from and after its effective date become a supplement to and part of the Zoning Enabling Ordinance. SECTION 5. This Ordinance shall be and it is hereby declared to be in full force and effect from and after thirty (3Q) days after the date of its passage, and before the expiration of fifteen (15) days after its passage this Ordinance shall be published once with"the names of the members voting for and against it in the Chi.CO Enter rise , 6 7 8 9, 10 lx 12 13~ 14 15 16 17 18 19' 20 21 22 23 24 23 26 27 28 28 30 31 32 a newspaper published in the County of Butte, State of California.
