HomeMy WebLinkAbout978 QI2DINANCE NO. 978 1 2 3 4 5 8 7 8 9 10 11 12 13 14 15 16 17 18 19 20 ', 21 22~ 23 24 25 26 27 28 29 30 31' 32 AN ORDIRTANCE ZC?NING A PORTION OF BUTTE COUNTY, STATE OF CALIFORNIA, PURSUANT TO ORi~INANCE 1~T0$. 475, 522 and 676 OF` SAID COUNTY The Board of Supervisors of the County of Butte, State of Cali- fornia, under and puzsuant to Ordinance No. 475 being the zoning Enabling Ordinance of said County as amended by Ordinance N'as. 522 and 676, DOES ORI9AIN AS FOLLOVdS: SECTION 1. The hc-reinbelow described area, situate in the County of Butte, State of California, shall be and it is hereby zoned as "S-1".(Minimum-Density Suburban Residential), "R-3" (Medium Density Residential), and "C-2" (General Commercial) District, and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided. Said area so zoned being located in the unincorporated area of Butte County, north and west of the City of Chico, California, particularly described as follows: As shown by map attached and as shown by map in the offiice of the Butte County Planning Commission. SECTION 2. REGULATIONS FOR AN "5-1" (MINIMUM-bENSITY SUBURBAN RESYDENTIAL) DISTRICT. The following regulations shall apply in an "S-1" District:. 2.1 U5ES PERMITTZrT~: a. Single-family dwellings, not including tents or trailers. b. Accessory buildings pertinent to the permitted uses. 2.2 AGRICULTURAL USES, EXCEPT LIVESTOCK T,+R-ITCH ARE SLT~3JECT TO THE FOLLOr~ING REQUIREMENTS: a. For each horse or head of cattle over one year, one acre. b, For each head of swine over ten (10) weeks of age, one acre. c. For each head of sheep or goats; one acre for the first head and one-half acre for each head thereafter. 2.3 LOS AREA REQUIRED: Minimum lot area shall not be less than eight thousand, one hundred twenty-five (8,125) square feet. 2.4 LOT WIDTH REQUIRED: Minimum lot width shall not be less than sixty-five (f~5) feet. 2.5 FRONT YARD REQUIRED: Minimum front yard shall be fifty (S0) feet from the centerline of the road, except where the road is classified by the County as a Federal Aid Secondary Road, the minimum building setback requirement shall be fifty-five (55} feet from the centerline of said road. 2.6 SI7DE XARD REQUIREMENT; Minimum side yards shall not be less than five (5) feet. 1 2 3 4 5 6 I 7 8 9' 10: 11 12! 13 l~k 15 16 17; 18' 19 20 21 22 23 24 25 2B 27 28 29 30 31 32 SECTION 3. REGULATIONS FOR AN "R-3" (MEDIUM DENSITY RESI- DENTIAL) DISTRICT. The following regulations shall apply in an "R-3" District: 3.1 USES PERMITTED: a. One-family dwellings, two-family dwellings and multi- family dwellings, not includling tents or trailers. b. Accessory buildings pertinent td the permitted uses.. c. Household pets (but not including livestock, poultry or poisonous reptiles). 3.2 LOT AREA REQUIRED: Minimum required area of a lot shall not be less than eijht thousand, one hundred twenty-five (8,125) square feet. 3.3 LOT WIDTH REQUIRED: Minimum lot width shall not be less than sixty-five (65) feet. 3.4 FRONT YARD RDQUIREI~: Minimum front yard shall not be less than fifty (50) feet from the centerline of the road, except where the road is classified by the County as a Federal Aid Secondary Road, the minimum building.setbac3.c requirement shall be fifty-five (55) feet from the centerline of: said road. 3.5 SIDE YARD REQUIREMENTt Minimum s$C~a yard shah, not be less than five (5) fast, 3.6 OFF-STREET PARKING: Off-street packing shall be provided on the basis of one parking space for each dwelling unit. 3.7 THE FOLLOWING USES SUBJECT TO SECURING A USE PEdRMIT IN EACH CASE: a. Golf courses and country clubs. b. Public and quasi-public uses including churches, fire houses, hospitals, parks and playgrounds, schools and public utility buildings. SECTION 4. REGULATIONS FOR A "C-2" (GENERAL COMMERCIAL) DISTRICT: The following regulations ,shall apply in a +-'C-2" District: 4.1 USES PERMITTED; a. Dwellings and dwelling groups, subject to the build- ing site area, lot width and yard requirements specified for residential districts. b. A11 uses permitted in "C-1" (Light Commercial) dis- tricts. c. General commercial uses including art shops, aviaries, bar and cocktail lounges, billiard parlors and pool halls, bowl- ing alleys, building material (retail), cleaning and pressing establishments, dance halls, interior decorating shops, employ- xaent agencies, govermental legislative buildings, gymnasiums, public, commercial or physical cultural studios, hospitals, -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 I4 15 16 17 18 19 20 2I 22 23 24 25 ' 26 27 28 29 30 31 32 hotels and motels, laboratories and x-ray facilities, massage parlors and reducing salons, equipment rentals, pet shops, used car lots, repair garages, auto car washes, plumbing shops, cabi- net shops, sign manufacturing shops, and other retail establish- ments when interpreted as similar. d. Accessory uses and buildings pertinent to a permitted use. 4.2 LOT '44IDTH REQUIRED; Minimum lot width shall not be less than twenty-five {25) feet. 4.3 FRONT YARD REQUIRED: None, except buildings and struc- tures shall be fifty (50) feet from the centerline of the road, except where the road is classified as a Federal Aid Secondary then the minimum setback shall be fifty-five (55) feet from the centerline of said road. 4,4 SIDE YARD REQUIREMENT: None, except where the,side of a lot abuts upon the side of a lot in an '+R'+ District, in which case the abutting side yard shall not be less than five {5) feet; and except where the side yard on the street side of a corner''ldt abuts on an t+R+i District, in which case the street side shall be one-half the corresponding front yard required in such "R" District, The side yard requirements for residential dwellings shall conform to the requirements for any residential-zone. 4.5 REAR; YARD REQUIRED; Twelve (12) feet, or five (5) feet adjacent to an alley. 4.6 THE FOLLOWING USES SUBJECT TO SECURING A USE PERMIT IN EAex cASE: a. Automobile courts and mobile home parks. b. Public and quasi-public uses, including churches. c. Small animal hospitals, dance academies, pet shops, mortuaries, used car sales, used or secondhand good~,refreshment stands, service stations, drive-in restaurants and other uses which are of similar character. SECTION 5. All uses of land within the District not specific- ally authorized and permitted are prohibited. SECTION 6. Penalties fox any violation of the zoning hereby imposed within the District shall be as provided in the Zoning Enabling Ordinance. This Ordinance shall be and it is hereby declared to be in full force and effect from and after thirty (30) days after the date of its passage; and before the expiration of fifteen (15) days after its passage this Ordinance shall be published once with the names of the members eating fox and against it in the Chico Enterprise , a newspaper published in the County of Butte, Stat6 of California.
