RESOLUTION FOR ANNEXATION TO COUNTY SERVICE AREA NO. 23
PLEASANT VALLEY DRAINAGE DISTRICT
WHEREAS, pursuant to Title III, Division II, Part 2, Chapter 2.2 of the Government Code of
the State of California, commencing with Section 25210.1, Rick Coletti has petitioned the Local
Rgency Formation Commission ("LAFCO") for the annexation of Ravenshoe Way Subdivision to
County Service Area No. 23 (Pleasant Valley Drainage District); and
WHEREAS, on March 6, 1997, t_AFCO adopted and passed Resolution No. 97-26 making
determinations and approving the annexation of the Ravenshoe Way Subdivision to County Service
Area No. 23; and
WHEREAS, the focal Agency Formation Commission has certified that it has reviewed and
considered the Negative Declaration prepared by the City of Chico and there are no sufficent grounds
to require supplementing the environmental document as prepared; and
WHEREAS, said Resolution adopted and passed by LAFCa authorized the Board of
Supervisors of the County of Butte to conduct proceedings for the annexation to County Service Area
No. 23 without notice and hearing and the Board may proceed in such manner pursuant to
Government Code Section 25210.14.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE
COUNTY OF BUTTE, STATE OF CALIFORNIA, as follows:
1. Said Board hereby finds and determines that the proceedings herein were conducted
pursuant to Section 25210.1 et. seq. of the Government Code.
2. The Board hereby determines to annex Ravenshoe Way Subdivision to said County
Service Area No. 23 (Pleasant Valley Drainage} without notice and hearing.
3. The subject area includes approximately 2.81 acres identified as APN's 048-340-060 and
061 and is to include Floral Avenue from the northern boundary of the project site southerly to East
Avenue.
4. The boundaries of the annexation to said County Service Area No. 23 are hereby finally
determined and established to be the same as shown on Exhibit "A" attached hereto and incorporated
herein and made a part hereof by this reference.
5. The subject annexation is assigned the following short farm designation: 97-22 -
Annexation to County Service Area No. 23 (Pleasant Valley Drainage District}.
6. The fallowing types of services are hereby found to be extended County services and are
to be provided within said area: drainage facility maintenance.
7. In accordance with the provisions of Government Code Section 25210.77(x} and Butte
County Code Sections 21.85 through 21.90, aper-parcel service charge shall be levied against all
the parcels within County Service Area Na. 23. Each parcel shall be assessed an individual service
charge based upon benefit. Said charge shall appear as a separate item on the tax bill and shall be
collected at the same time and in the same manner as ordinary County ad valorem taxes are
collected and shall be subject to the same penalties and the same procedure and sale in the case
of delinquency as provided for such taxes. All laws applicable to the levy, collection and enforcement
of County ad valorem taxes are collected and shall be subject to the same penalties and the same
procedure and sale in the case of delinquency as provided for such taxes. All laws applicable to the
levy, collection and enforcement of County ad valorem taxes shall be applicable to such charge,
except that if real property to which such charge relates has been transferred or conveyed to a bona
fide purchaser for value, or if a lien of a bona fide encumbrance for value has been created and
attached thereon, prior to the date on which the first installment of said taxes would become
delinquent, then the charge confirmed shall not result in a lien against said real property but instead
shall be transferred to the unsecured roll for collection.
8. Currently, there is no additional charge to fund the drainage services within County Service
Area IJo. 23. Any new and/or increased charges would need to be processed in accordance with the
provisions of Proposition 218.
9. Said County Service Area No. 23 is established far all purposes subject only to compliance
with the requirements of Chapter 8 (commencing with Section 54900}, Part I, Division 2, Title 5 of the
Government Code and subject to the provisions of Article 2.5 (commencing with Section 25210.21 },
of this chapter.

California, on the
