HomeMy WebLinkAbout98-011~,~~ ~~- SU~,~,•+i+ 1 i ~ ©t ~' • ~~ +iA ~C . ; '7~' .; ~C~... ..• G +• COUNTY Off' k~UTI`E, .STATE OF I_It~'U#~I~JfA , 1\ :'Sc7j li f 11111 ~~ i?. 98-11 RESOLUTION DISSOLVING COUNTY SERVICE AREA NO. 147 MARIGOLD ESTATES SUBDIVISION AND THE SPHERE OF INFLUENCE WHEREAS, pursuant to Title III, Division II, Part 2, Chapter 2.2 of the Government Gode of the State of California, commencing with Section 56759, preliminary proceedings have been initiated for the dissolution of County Service Area No. 147; and WHEREAS, on November 6, 1997, the Local Agency Formation Commission passed and adopted Resolution No. 97-35 making determinations and approving the proposed dissolution of County Service Area No. 147; and WHEREAS, the reason for the proposed dissolution of County Service Area No. 147 and the co-terminus sphere of influence is that the City of Chico is currently providing the services previously provided by Butte County as a general service and the county service area is no longer necessary to provide financing; and WHEREAS, the Local Agency Formation Commission has certified that the project is a General Rule Exemption under the California Environmental Quality Act per Section 15061. A Notice of Exemption was filed with the County Clerk on November 13, 1997. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California, as follows: 1. Said Board hereby finds and determines that the proceedings herein were conducted pursuant to Chapter 2.2 of Part 2 of Division II of Title III of the Government Code commencing with Government Code Section 25210.1, and in particular with Article 2 thereof commencing with Section 25210.10, and with Part 4 of Division III of Title V of the Government Code commencing with Section 57000. 2. The subject territory includes approximately 20 acres of private property and is assigned the following distinctive short term designation: 97-30 -Dissolution of C.S.A. No. 147 (Marigold Estates Subdivision). 3. All Butte County, State of California, and any other remaining obligations shall be paid from funds remaining in the county service area budget prior to filing the Certificate of Completion. 4. Any funds remaining in the county service area budget shall be transferred to the City of Chico. 5. The boundaries of the territory proposed to be dissolved are described in Exhibit "A" attached hereto and made a part hereof by this reference. 6. The Clerk of the Board is authorized and directed to file a certified copy of this Resolution with the Executive Officer of the Butte County Local Agency Formation Commission.
