UTION ESTABLISHING INCREASED SERVICE CHARGE
IN COUNTY SERVICE AREA 90 (SOUTHGATE ACRES}, ZONE 3

WHEREAS, the Board of Supervisors of the County of Butte adopted Resolution 97-1.65 on
December 9, 1997, directing commencement of procedures to increase the maximum annual service
charge in County Service Area 90, Southgate Acres, Proposed Zone 3, setting a public hearing to
consider levying such increased charge, and directing the conduct of a property owner ballot proceeding
rega--ding such charge; and
t~'HEREAS, a written report identifying each parcel of real property receiving a particular
extended service, and the amount of the increased annual charge proposed for each parcel, has been filed
with the Clerk of the Board of Supervisors and resides in the Property Tax Section of the Auditor's
Office: and
WHEREAS, notice having been duly given and a public hearing having been held on this day to
consider levying such increased service charge for future fiscal years, in accordance with the procedures
specified in Article XI11 D, Section 6, of the California Constitution, and to consider protests against such
service charge; and
WHEREAS, a property owner ballot proceeding was held in connection with said hearing, there
was no majority protest, and a majority of the ballots submitted were in favor of the proposed service
charge.
NOW, THEREFORE, BE iT RESOLVED,
I . It is found that a majority of the ballots submitted were in favor of the proposed increased service
charges being levied.

2. Zone ~ of CSA 90, as depicted on Exhibit A attached hereto, is hereby established.
~. In accordance with Article XIII D, Section 6, of the California Constitution a maximum annual service
charge rate of $209.00 ($34.38 existing plus $174.62 new) per parcel of real property within County
Service Area 90, Zone 3, is hereby established for future fiscal years.
PASSED AND ADOPTED by the Board of Supervisors of the County of Butte, State of
California, this `L7tlbay of January 1998 by the following vote:
