Resolution No. 98-18
RESOLUTION RATIFYING PROCLAMATION OF A LOCAL EMERGENCY AND
REQUESTING THAT THE GOVERNOR PROCLAIM THE COUNTY OF BUTTE TO BE
IN A STATE OF EMERGENCY
WHEREAS, Section 8-5 of the Butte County Code empowers the
Director of Emergency Services of the County of Butte to proclaim
the existence or threatened existence of a local emergency when
said County is affected or likely to be affected by a local
emergency and the Board of Supervisors is not in session; and
WHEREAS, conditions of extreme peril to the safety of persons
and property have arisen within said County, in that commencing on
or about 6 p.m. an Monday, February 2, 1998, a succession of wind
and rainstorms has resulted in the wide spread flooding of law
lying residential and agricultural areas in Butte County causing
and threatening significant property damage. In addition the
National Weather Service has advised that significant additional
rain is expected to continue through Saturday, February 7, 1998.
Should these wind and rain storms continue, additional flooding,
property damage and loss of life may occur;
WHEREAS, the aforesaid conditions of extreme peril did warrant
and necessitate the proclamation of the existence of a local
emergency;
WHEREAS, at the time of the commencement of the said local
emergency the Board of Supervisars was not in session (and could
not immediately be called into session); and
WHEREAS, the Director of Emergency Services of the County of
Butte did proclaim the existence of a local emergency within said
County on the 2nd day of February, 1998; and
WHEREAS, it is hereby found that local resources are unable to
cope with the effects of said emergency.
NOW, THEREFORE, IT IS HEREBY PROCLAIMED AND ORDERED that the
Proclamation of Existence of a Local Emergency, as issued by said
Director of Emergency Services, is hereby ratified and confirmed
by the Board of Supervisors of the County of Butte;
IT IS FURTHER PROCLAIMED AND ORDERED that the Proclamation of
Existence of a Local Emergency shall be deemed to continue to exist
until its termination is proclaimed by the Board of Supervisors of
the County of Butte; and
IT IS FURTHER PROCLAIMED AND ORDERED that during the existence
of said local emergency the powers, functions and duties of the
emergency organization of this County shall be those prescribed by
state law, by charter, ordinances, and resolutions of this County,
and by the County of Butte Emergency Plan, as approved by the Board
of Supervisors on December 10, 1996.
IT IS FURTHER ORDERED that a copy of this resolution be
forwarded to the Governor of California with the request that he
proclaim the County of Butte to be in a state of emergency, and
with the further request that the Governor request a Presidential
Declaration.
IT IS FURTHER ORDERED that a copy of this resolution be
forwarded to the Sate Director of the Office of Emergency Services.

this 4th day of February, 1998, by the following vote:
AYES: Suprvisors Beeler, Dolan, Houx, Josiassen and Chair Davis
