HomeMy WebLinkAbout98-073~, ~'~: B4~RD QF SU`~E~-1/ISO' ~QUNTY OF BUTTE, STATE pF {CALIFORNIA Resolution N0. 98-73 RESOLUTION EXCHANGING DRAINAGE, FLOWAGE AND PUBLIC UTILITY EASEMENTS WHEREAS, the County previously accepted the offer of dedication of the following easements: A 3 foot wide public utility easement along the northeasterly line of Lot 9 shown on the subdivision map entitled °Southgate Industrial Park Unit No. 1 ", Book 43 of Maps, Pages 1 and 2. 2. A flowage easement shown on a parcel map, Book 45 of Maps, Page 28 and Book 1816 of Official Records at Pages 440 thru 443. 3. A 20 foot wide drainage easement, Baok 18I I of Official Records at Pages 314 and 315. Said easements more particularly described in Exhibit A attached hereto; and WHEREAS, the affected property owners wish to relocate said easements to a mutually agreed upon location and to deed an easement in a new location to the County of Butte; and WHEREAS, upon said relocation, the easements in their original location will not be necessary for the Public or County use; and WHEREAS, the easement in this new location, as described in the Grant Deed attached hereto as Exhibit B, may be necessary for the Public or Cou~lty use; WHEREAS, the said easements to be exchanged are of equal value; and WHEREAS, said exchange and the termination and abandonment of the ease~7~ents in their original locations will not cut off all access to any person's property which, prior to relocation, ~ ,rF~~i~,..,~~~i ~,,r oa °,~ ~ adjoined said easements and, the easements being terminated are being superseded by relocation and there are no other public facilities within the easements. NOW THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte as follows: 1. The easements described in Exhibit A attached hereto, are terminated and abandoned pursuant to Govermnent Code Section 6647~.2(C) and Chapter 4 of Part 3 of division 9 of the Streets and Highways Code commencing with Section $330 and are exchanged for the easement described in Exhibit B attached hereto, pursuant to Government Code Section 25365. 2. Said termination and abandonment and exchar~~ge shall be effected upon recordation of this resolution and the following deeds: Quit Claim Deed -Butte County to Rausser (3'P.U.E.) Quit Claim Deed -Butte County to Rausser and Ramsey (flowage easement) Quit Claim Deed -Butte County to Rausser and Ramsey {drainage easement) Grant Deed -Ramsey to Butte County {drainage easement) PASSED AND ADOPTED by the Butte County Board of Supervisors this 12th of May 1998 by the following vote: AYES: Supervisors Beeler, Dolan, Houx, Josiassen and Chair Davis NOES: None ABSENT: None ---' NOT VOTING: Nane t ._ J ! FLOWAGE EASEMENT lying within the following described parcel: Beginning at the most southerly corner of Lot 8 as shown on that certain map entitled "Southgate Industrial Park Unit No. One" recorded in the office of the County Recorder of the County of Butte, State of California in Book 43 of Maps at pages 1 and 2, said corner also lies on the northwesterly right-of-way line of Loren Avenue; THENCE North 48°58'26" East, along said right-of-way line and the southeasterly line of said Lot 8 and its projection thereof a distance of 190.00 feet to the most southerly corner of Lot 7 as shown on the aforementioned subdivision map; THENCE leaving said right-of-way line, North 41°01'34" West, clang the southwesterly line of Lots 7 and 3 as shown on the aforementioned subdivision map, a distance of 505.38 feet to the most westerly corner of said Lot 3; THENCE South 56°38'50" West, a distance of 252.92 feet to the beginning point of a tangent curve to die left; THENCE along said curve having a radius of 70.00 feet through a central angle of 97°40'24", an arc length of 119.33 feet; THENCE Soud1 41°01'34" East, a distance of 309.78 feet to the most westerly corner of Lot 9 as shown on the aforementioned subdivision map; THENCE continuing Saud1 41°01'34" East, along die southwesterly line of said Lot 9, a distance of 140.00 feet to the beginning of a tangent curve to the left; THENCE along said curve having a radius of 20.00 feet through a central angle of 90°00'00", an arc length of 31.42 feet to a point on the northwesterly right-of-way line of Loren Avenue; THENCE North 48°58'26" East along said right-of-way line and along the southeasterly line of said Lot 9, a distance of 120.00 feet to die Point of Beginning; I:AFrtiJCCTS\9'l;l\_kf ,^,', L L61596 1 The above-described parcel contains 3.96 acres, more or less.
