RESOLUTION MAKING APPLICATION TO THE
LOCAL AGENCY FORMATION COMMISSION FOR ANNEXATION
OF TERRITORY TO COUNTY SERVICE AREA NO. 24
(CHICO iVIUD CREEK DRAINAGE)
WHEREAS, there are tour properties within County Service Area No. 24 that are receiving two
tax bills each due to split lines of assessment; and
WHEREAS, in fairness to the taxpayers, the boundaries should be amended to eliminate the split
line of assessment.
WHEREAS, the Board of Supervisors ofthc County of Butte, by this Resolutio~l, now desires to
initiate proceedings to annex four parcels (APN's 007-550-OG6, 468, 075 and 078) to County Scrvicc Area
No. 24 pursuant to the Cortese-Knox Local Government Reorganization Act oi' 1985, as set forth in
Division 3, Title 5 of the California Government Code (commencing with Section 56000); and
V1'HEREAS, the Local Agency Formation Commission has waived the fees for applications
submitted by the Board of Supervisors eliminating a substantial portion of the cost; and
WHEREAS, the State Board of Equalization requires payment of a filing fee for any change of
organization.
NO1~', THEREFORE, BE IT RESOLVED and ordered by the Butte County Board of
Supervisors as follows:
Application and a proposal is hereby made to the Butte Local Agency Formation
Commission for the annexation of the aforementioned territory to County Scrvicc Area No. 24
pursuant to the Cortese-Knox I,oca1 Government Reorganization Act of 1985, as set forth in
Division 3, "Title 5 of the California Government Code (commencing with Section 56000).
2. "The nature of- the proposed change of organization is for the annexation of the
aforementioned territory to County Service Area No. 24 {Chico Mud Creek Drainage) lying within
the unincorporated territory of the County of Butte.
3. I'he territory proposed to be annexed to County Service Area No. 24 has been deemed
to be uninhabited.
4. The reason for said proposal is to eliminate the line of assessment which causes two tax
bills to be created for each parcel.
5. No fees are to be paid to the Butte Local Agency Formation Commission.
6. State Board of Equalization fees shall be paid by the County of Butte.
7. The Clerk of the Board is authorized and directed to file a certified copy of this resolution
with the Executive Officer of the Butiie I.~ocal Agency Formation Commission.
PASSED AND ADOPTED by the Butte County Board of Supervisors this 26th day of
rTay 1998, by the following vote:
AYES: Supervisors Beeler, Dolan, ttoux, Josiassen and Chair Davis
