"'°! RESOLUTION MAKING APPLICATION TO THE BUTTE
FOCAL AGENCY FORMATION COMMISSION
FOR DETACHMENT OF TI+:RRITORY FROM COUNTY SERVICE AREA NO. 16
(WEST CHICO LIGHTING DISTRICT)
WHEREAS, there are six properties within the City of Chico that are continuing to be taxed for
County Service Area No. 16 (West Chico Lighting District) ;and
WHEREAS, the six properties were annexed to the City of Chico on May 5, 1997 as a part of 97-
12 -West Chico Annexation No. 2.
WHEREAS, the Board of Supervisors of the County of Butte, by this Resolution, now desires to
initiate proceedings to detach said six properties (APN's 043-290-039, 047, 071,110, 136 and 137) from
County Service Area No. 16 pursuant to the Cortese-Knox Local Goven~ment Reorganization Act of 1985,
as set forth in Division 3, Title 5 ofthe California Government Code (commencing with Section 56000);
and
WHEREAS, the Local I~gency Formation Commission has waived fees for applications submitted
by the Board of Supervisors eliminating a substantial portion of the costs.
NOVY, THEREFORE, BE IT RESOLVED and ordered by the Butte County I3oard of
Supervisors as follows:
Application and a proposal are hereby made to the Butte Local Agency Fot7nation
Commission for the detachment of the aforementioned territory from County Service Area No. 16
pursuant to the Cortese-Knox Local Goven~ment Reorganization Act of 1985, as set forth in
Division 3, Title 5 of the California Government Code (commencing with Section 56000).
2. The nature of the proposed change of organization is for the detach~l~ent of the
aforementioned territory from County Service Area Na. 16 (West C'hieo Lighting District) lying
within the unincorporated territory of the Cou~~ty of Butte.
3. The territory proposed to be detached from County Service Area No. 1(~ has been deemed
to he inhabited.
4. The reason for said proposal is that the aforementioned parcels were annexed to the City
of Chico on May 5, 1997 as a part of 97-12 -Nest Cl~~ico Annexatioi~~ No. 2.
5. No fees are to be paid to the Butte Local Agency Forn~ation Commission.
6. Tl~~e Clerk of the Board is authorized and directed to frle a certified copy of this Resolution
with the Executive Officer of the Butte Local Agency Formation Commission.
PASSED AND ADOPTED by the Butte County Board of Supervisors on this 26th day of
May , 1998, by the following vote:
AYES; Supervisors Beeler, Dolan, Houx, Josiassen and Chair Davis
