COUNTY Off' ,``~"E; STATE C`9~' ~//~LIIGC~~P*l't~4 r ;. :~ *i ~. ~~ ' ~~° ~.;~~ .....•• , j ~~~'' ~~ ~i ~'S~~t of 1t~ii .~ t~. 98-94 r~~+~~~~ RESOLUTION APPROVING THE EXPANSION OF POWERS OF COUNTY SERVICE AREA NO. 128 (WILDFLOWER ESTATES SUBDIVISION) WHEREAS, heretofore on April 28, 1998, the Board of Supervisors of the County of Butte, State of California, adopted and passed a resolution of intention to extend fire suppression system maintenance within the established County Service Area No. 128; and WHEREAS, said resolution fixed the 9th day of June 1998 at 10:00 a.m. in the Board of Supervisors Room of the County of Butte Administration Center in the City of Oroville, State of California, as the time and place for the public hearing on the extension of said services to the existing County Service Area No, 128 and the assessment of a service charge; and WHEREAS, on Apri12, 1998, the Local Agency Formation Commission passed and adopted Resolution No. 11 97198 approving the Expansion of Powers of County Service Area No. 128; and WHEREAS, the Local Agency Formation Commission has certified that the proposal is Categorically Exempt from the Califol7lia Environmental Quality Act, per Section 15301 {a), which exempts maintenance of existing public facilities which involve no expansion of use. WHEREAS, no written protest against the establishment and extension thereof was filed in accordance with Government Code, Section 25210.17. NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of the County of Butte, State of California, as follows: 1. Said Board hereby finds and determines that the proceedings herein were conducted pursuant to Section 2.2 of Part 2 of Division 2 of Title 3 of the Government Code, commencing with Government Code Section 25210.0, and in particular with Article 3 thereof, commencing with Section 25210.30, and with Part 4 of Division 3 of Title 5 of the Government Code, commencing with Section 57000. 2. Said Board finds that the Expansion of Powers is consistent with the Board of Supervisors approval of the Subdivision Map recorded for the Wildflower Estates Subdivision. 3. Said Board finds that the Expansion of Powers far County Service Area No. 128 is Categorically Exempt from the California Environmental Quality Act, per Section 15301 {a), which exempts maintenance of existing public facilities which involve no expansion of use. 4. Said Board hereby determines to approve the Expansion of Powers for County Service Area No. 128 as specified below. 5. The area within which such extended services would be provided is the existing area of County Service Area No. 128. 6. The short form designation of these proceedings is 98-11 -Expansion of Powers of C.S.A. No. 128 (Wildflower Estates Subdivision). 7. The following type of service is found to be an additional extended service and is to be provided within said area: fire suppression system maintenance. 8. In accordance with the provisions of Government Code Section 25210.77a and Butte County Code Sections 21.85 through 21.90, and following a public hearing thereon, a per parcel service charge shall be levied against all the parcels tivithin County Service Area No. 128. Each parcel shall be assessed an individual service charge based upon benefit. Said charge shall appear as a separate item on the tax bill and shall be collected at the same time and in the same manner as ordinary county ad valorem property taxes are collected and shall be subject to the same penalties and the same procedure and sale in case of delinquency as provided for such taxes. All laws applicable to the levy, collection and enforcement of county ad valorem taxes shall be applicable to such charge; except that if for the first year such charge is levied the real property to which such charge relates has been transferred or conveyed to a bona fide purchaser for value, or if a lien of a bona fide encumbrancer for vahie has been created and attached thereon, prior to the date on which the first installment of said taxes would become delinquent, the charge confirmed shall not result in alien against such real property but instead shall be transferred to the unsecured roll for collection.
