RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE
AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO ENTER INTO
CONTRACTS FOR EMERGENCY STORM DAMAGE REPAIR
WHEREAS, California Public Contract Code Section 22050 provides authority to the
Board of Supervisors in the event of an emergency, to repair or replace any county public facility,
when repair or replacements are necessary to permit the continued conduct of county operations
or services and, by afour-fifths vote, said Board of Supervisors may proceed at once to repair or
replace any county public facility without adopting the plans, specifications or working details, or
giving notice for bids to let contracts, and;
~%VHEREAS, the Board of Supervisors has determined that in the cases of emergency, the
Director of Public Works shall have the authority to order any action specified in Public Contract
Code Section 22050 (a)(1) to avoid delay in dealing with such emergencies.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Supervisors of the County of
Butte, State of California, as follows:
The Board of Supervisors, in the event that a Proclamation of Existence of a Local
Emergency has been adopted by said Board of Supervisors, hereby delegates to the Director of
Public Works the authority to act in case of an emergency to repair or replace a public facility,
take any directly related and immediate action required by that emergency, and procure the
necessary equipment, services and supplies for those purposes without giving notice for bids to let
contracts.
PASSED AND ADOPTED by the Board of Supervisors of the County of Butte, State of
California, this 14th day of July , 1998, by the following vote:
AYES: Supervisors Dolan, Roux, Josiassen and Chair Davis
NOES: None
ABSENT: Supervisor
NOT VOTING: None
