COUNTY OF OF ~UPERVI~O-RS BUTTE, STATE OF CALIFORNIA ~trO~~~`~~ Resolution No. 98-118 ~~11^ rrr RESOLUTION CALLING AN ADVISORY ELEC'T'ION REGARDING SEWER CONNECTIONS [N THE CHICO URBAN AREA PURSUANT TO 1'HE CHICO URBAN AREA NI'I'RATh, COMPLIANCE PROGRAM WHEREAS, heretofore on the 20th day of December-, 1988, the Board of Supervisors of the County of Butte adopted and passed a resolution (Resolution No. 88-194) to establish a county service area to be entitled County Service Area No. 114 (County of Butte); and WHEREAS, heretofo~~e on the 17th day of September, 1991, the Board of Supervisors of the County of Butte adopted and passed a resolution (Resolution No. 91-108) to order the expansion of potivers for County Service Area No. 1 l4 (County of Butte); and WHEREAS, the types of extended county services provided within County Service Area No. 1 14, in addition to those authorized by Resolution No. 88-194 are: sewer service, drainage control and road maintenance, limited to the preparation of detailed engineering studies dealing with the design of wastewater and storm water collection, transportation, disposal and drainage facilities and structures to protect the quality of groundwater in the area; and WHEREAS, the State of California Regional Water Quality Control Board Central Valley Region on April 27, 1990 issued Prohibition Order No. 90-126 to address groundwater nitrate contamination in the Chico Urban Area, which requires the abandonment of thousands of area septic systems; and WHEREAS, in response to Prohibition Order No. 90-126, the Board of Supervisors has prepared the Draft Chico Urban Area Nitrate Co~~npliance Plan, which draft was released for public review and input on March 24, 1998; and WHEREAS, the Draft Chico Urban Area Nitrate Compliance Plan describes the implementation procedures necessary to address groundwater nitrate contamination, the abandonment of area septic systems, and the connection of more than 7,000 dwelling units within hoth the incorpo~ ated and the unincorporated Chico Urban Arca to a sewer collection system; and WHEREAS, the City of Chico operates a water pollution control plant facility and sewer collection system within the incorporated limits of the City of Chico; and WHEREAS, the City of Chico's current policy for providing sewer service is to require that those properties connecting to sewer must become annexed to the City of Chico; and WHEREAS, at its July 21, 1998 meeting, the City Council of the City of Chico passed a resolution calling a general municipal election on November 3, 1998 for the purpose of submitting to qualified voters of the City of Chico an advisory measure regarding City policy limiting City sewer services to property within the City's boundaries and requesting consolidation of that election with the Statewide general election to be held on November 3, 1998; and WHEREAS, an advisory election would allow such an expression of public opinion whether those residents of the unincorporated portion of the Chico Urban Area that are impacted by Prohibition Order No. 90-126 should be annexed to the City of Chico for receiving sewer services; and WI IEREAS, Elections Code Section 9603 provides a procedure whereby an advisory election may be held for the purpose of allowing voters to voice their opinion on substantive issues or to indicate to the Board of Supervisors approval or disapproval of a ballot proposal. WHEREAS, a question, which is attached hereto as Exhibit A, has been prepared for the advisory ballot. NOW, 'hHEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California as follows: L ~n advisory election is hereby called to be held on November 3, 1998, within the incorporated tei7-itory of the City of Chico in the County of Butte. 2. The question to be submitted to the voters at said advisory election shall be the question attached hereta as Exhibit A. 3. Said election shall be held and conducted by the County and the ballots canvassed in accordance with the provisions of Article 1 (commencing with Section 3700) of Chapter 2, Division 4 of the Elections Code. The County Clerk shall publish a notice of the election pursuant to Elections Code Sections 254 and 2653. 4. Said election shall be consolidated with the general election to be held in the same area on the same date. The hours of the election, the precincts, polling places, and voting booths shall be the same, and there shall be only one set of election officers in each of the precincts. The State of California has ordered over 7,000 residences to eliminate their septic systems. Connecting these properties to the City of Chico's sewer system without mandatory annexation is a solution. These residents would pay their costs and City residents would not incur any costs. Should the residents affected by the order be required to annex to the City of Chico in order to connect to the sewer system'? (Yes or 1\0}
