HomeMy WebLinkAbout98-125,~_ GQUIVTY QF Bl,1TT~, aT~ATE 4F CALIFORNIA ~e'SOlilfl0ti N0. 98-125 RESOLU'I"ION APPROVING RF.POK`I" AND ASSI?SSMI;N"I' AND ORDERING IMPROVEMENT DRESCHER TRACT ASSESSMENT DISTRICT The Board of Supervisors of the County of Butte resolves: This I3oard has taken a series of actions preliminary to ordering the improvement in Drescher Tract Assessment District, Butte County, California, and now makes the following findings and orders: 1. `I"hc Board adopted a map showing the boundaries of the land benefited by the proposed improvement. A copy of the boundary map was filed in the office of the County Recorder of the County of Butte in the Book of Maps of Assessment and Community Facilities Districts. 2. The Board adopted its Resolution of Intention to order the improvement described therein under the Municipal improvement Act of 1913, and directed Northstar I3ngineering, as the F,ngincer of 1x'ork for the assessment district, to prepare the report required by Section 10204 of the Street`s and Highways Code. The improvement is generally described as follows: The widening and resurfacing of Drescher `Tract Road to bring the road up to County of I3uttc standards for public roads, including the modification of existing drainage crossings as needed and any necessary road base. 3. 7`hc Engineer cif Work filed the report as directed, and the I3oard of Supervisors called a hearing on the report as required by Section 10301 of the Streets and Highways Code. Notice of hearing was given by mailing to affected property owners, all according to the Municipal Improvement Act of 1913. An affidavit of mailing was filed with the Clerk of the I3oard. 4. Construction bids were opened on July 30, 1998. Changes to the Cost Estimate (Exhibit I3 of the Report) and the Property Owners List (Exhibit E of the Report) were necessary. Said changes were approved by resolution on August 11, 1.998, and the Clerk of the Board was directed to attach said Amended Cost Estimate and Amended Property Owners List to the Engineer's Report on file in his office. 5. At the time and place for which notice was given, the Board conducted the public hearing and gave every interested person an opportunity to object to the proposed improvement, the extent of the assessment district, or the proposed assessment. 6. '1'hc Board finds that written protests against the proposed improvement have not been made by owners representing more than one-half of the area of the land to be assessed for the improvement. The Board further finds that amail-ballot vote on the question of the proposed assessment was conduetcd in accordance with Article X1IID of the California Constitution, and that the ballots marked and returned do not constitute a majority protest as defined therein. 7. 1'hc document`s and events described in paragraphs 1 to 5, inclusive, arc stated here in tabular form, with their dates and, where appropriate, their numbers. The Board approves the Engineer's Report and each component part of it, including each exhibit incorporated by reference in the report. 9. 'I`he Board finds that the Engineer of Work in the Engineer's Report has fairly and properly apportioned the cost of the improvement to each parcel of land in the assessment district in proportion to the estimated benefits to be received by each parcel, respectively, from the improvement. 'I'hc Board hereby confirms and levies each individual assessment as stated in the I;ngincer's Report. 2 10. This Board orders the improvement described in paragraph 2 and as detailed in the Engineer's Report. 11. Bonds representing unpaid assessments, and bearing interest at a rate not to exceed twelve percent (12%} per annum, will be issued in the manner provided by the Improvement Bond Act of 191.5 (Division 10, Streets and Highways Code), and the last installment of the bonds shall mature not to exceed thirty-nine (39) years from the second day of September next succeeding twelve (12) months from their date. 12. According to Section 10603 of the Streets and Highways Code, the Board designates the County Treasurer to collect and receive payment of the assessments. "I'he property owners who elect to pay their assessments in cash before the issuance of improvement bonds will not be required to pay their pro rata share of the allowance for special reserve fund.
