DISSOLUTION OF THE LIME SADDLE, COMMUNITY SERVICES DISTRICT
WHEREAS, Section 99 of the Revenue and Taxation Code provides that upon the filing of
an application or a resolution pursuant to the Cortese-Knox Local Government Reorganization Act
of 1985, and prior to the issuance of`a certificate of filing by the Executive Officer of LAFCO, the
Executive Officer shall give notice of the filing to the Assessor and Auditor of each County within
the territory subject to the jurisdictional change; and
WHEREAS, the only local agency whose service area or responsibility will be altered by
the jurisdictional change in this case is the Lime Saddle Community Services District; and
WHEREAS, the Auditor has estimated the amount of property tax revenue generated within
the Community Services District during the current fiscal year; and
WHEREAS, as such jurisdictional change affects the service area or service responsibility
of one or more special districts, the Board of Supervisors has negotiated the exchange of property
tax revenues on behalf of the affected special district pursuant to Revenue and Taxation Code
Section 99 (b)(4) and {5); and
WHEREAS, it is necessary to notify the County Auditor-Controller regarding such exchange
so that he can adjust the allocation of property tax revenue accordingly.
NOW, THEREFORE, BE IT RESOLVED by the Butte County Board of Supervisors as
follows:
1. The Lime Saddle Community Services District allocation of property tax revenue shall
be transferred to the County of Butte General Fund.
2. The Butte County Auditor-Controller is hereby directed to establish a Trust Fund and
place such property tax allocation monies into said "Trust Fund. "Phis Trust Fund shall remain in
existence for a period of three years.
3. The purpose for which these trust funds may be used shall be for the resolution of
implementation of the pipeline construction for the improvement of the water supply to existing
users within the Lime Saddle Community Services District and Spring Valley School.
PASSED AND ADOPTED by the Butte County Board of Supervisors on this 27th day of
October 1998 by the following vote:
AYES: Supervisors Beeler, Dolan, Roux, Josiassen and Chair Davis
NOES: None
ABSENT: None
NOT VOTING: None
