HomeMy WebLinkAbout98-162RESOLUTION GOVERNING THE EXCHANGE OF PROPERTY TAXES FOR THE DISSOLUTION OF THE MAGALIA COUNTY WATER DISTRICT WHEREAS, Section 99 of the Revenue and Taxation Code provides that upon the filing of an application ar a resolution pursuant to the Cortese-Knox Local Government Reorganization Act of 1985, and prior to the issuance of a certificate of tiling by the Executive Officer of LAFCO, the Executive Officer shall give notice of the filing to the Assessor and Auditor of each County within the territory subject to the jurisdictional change; and WHEREAS, LAFCO the only local agency whose service area or responsibility will be altered by the jurisdictional change in this case is the Magalia County Water District; and WHEREAS, the Auditor has estimated the amount of property tax revenue generated within the Community Services District during the current fiscal year; and WHEREAS, as such jurisdictional change affects the service area or service responsibility of one or more special districts, the Board of Supervisors has negotiated the exchange of property tax revenues on behalf of the affected special district pursuant to Revenue and Taxation Code 9~) (b}(4} and (5); and WHEREAS, it is necessary to notify the County Auditor-Controller regarding such change so that he can adjust the allocation accordingly. NOW, THEREFORE, BE IT RESOLVED by the Butte County Board of Supervisors as follows: 1. That portion of the county wide property tax currently allocated to the Magalia County Water District shall be allocated to the County General Fund upon the dissolution of the District. 2. An executed copy of this resolution shall be submitted to the Executive Offcer of LAFCO and also to the County Auditor-Controller who shall make the appropriate adjustment as provided in subdivision (a) of Section 99 of the Revenue and Taxation Code.
