HomeMy WebLinkAbout99-002.4~} B~AR~ C~~' SUP~RV1~©RS CC3UNTY OF BUTTE, STATE OF CALIFORNIA Resolution No. 99-OZ RESOLUTION CONFIRMING AND INCREASING THE EXISTING SHERIFF'S EXTRADITION REVOLVING FUND {Government Code Section 29230 et. seq.} WHEREAS, the Board of Supervisors of the County of Butte, State of California has determined that f-or the of icient operation of the Sheriff's Office, the establishment of a Revolving Fund was necessary to provide a source of funding to pay for the transportation of prisoners; and WHEREAS, the Board of Supervisors established such a Revolving Fund on March 5, 1951, pursuant to Section 29320 et. seq. of the Government Code of t11e State of California; and WHEREAS, the amount of that Revolving Fund was increased to $20,000 by Resolution No. 91- 43; and WHEREAS, the State of California, Department of Corrections is not reimbursing extradition and transportation expenditures to the County in a timely manner resulting in that fund being depleted below a safe operational level; NOW, THEREFORE I3E IT RESOLVED, by the Board of Supervisors, as follows: That in order to provide sufficient available funding to pay far prisoner transportation and extradition, it is necessary to increase the amount o1'the Sheriff's Extradition Revolving Fund from the current $20,000 level to $50,000. 2. "fhat the Resolution adopted by the Board of Supervisors on March 5, l 951, be amended to read as follows: "3. f~ unding shall he provided as shown below: a. "fhat the total amount available for the purposes of this fund shall be fifty thousand dollars ($50,000}. This level of funding shall be provided for through a combination of the Sheriff s Revolving rued (in the form of a checking account) in the amount of $20,000 and a Sheriff's Extradition Trust (in the County Treasury) in the amount of $30,000. b. That the allocation between the two funds may be modified without need of further Board action if there is agreement between the Sheriff and the Auditor-Controller." 3. That this Fund is established and increased in accordance with Section 29320 et.seq. of the Government Code of the State of California, and that certified copies of the resolution shall be transmitted to the County Auditor and the County "Treasurer. 4. "That the Chief Administrative Officer and the Risk Manager are instructed pursuant to Section 29323 o~f the Government Code to amend by endorsement the blanket fidelity bond of the County to be conditioned in addition to its other provisions, upon the faithful administration of the Revolving Fund and upon the willingness and ability of the principal for whom such fund has been established to account for and pay over the fund upon demand of the Board of Supervisors at any time. 5. The Auditor of the County of Butte is hereby authorized and directed to draw a warrant in the sum of Thirty Thousand Dollars ($30,000) in favor of the Butte County Sheriff's Office -Extradition Fund from the County General Fund for the purpose of increasing the total of the Extradition fund to Fifty "Thousand Dollars 050,000}.
