HomeMy WebLinkAbout99-040.BOARD OF SUPERVISORS COUNTY OF BUTt'E, STATE OF CALIFORNIA; Resolution No. 99-40 RESOLUTION ESTABLISHING NEW SERVICE CHARGE FOR PROPERTY "I'O BE ANNEXED TO C:OUN'TY SERVICE AREA 137 FOR FISCAL YEAR 1999-2000 AND FUTURE YEARS (Andrew and Margo Wood, AP #040-490-008) WHEREAS, County Service Area 137 has been established to provide fire protection services; and WHEREAS, an application is pending before the Butte County Local Agency Formation Commission to allow annexation of Assessor Parcel 040-490-008 so that it may receive such services from said County Service Area; and WHEREAS, it is the intention of the County of Butte, upon approval by the Butte County Local Agency Formation Commission, to allow annexation of said property to the County Service Area only if service charges are established in an adequate amount to provide the contemplated services to that property; and WHEREAS, Government Code Section 25210.77a contains authority for the County of Butte to establish and collect service charges for extended services provided through a county service area or zone, and WHEREAS, the Board of Supervisors did, by ordinance adopt. Butte County Code Section 21-85 et seq., establishing a procedure for annually levying and collecting such charges on the tax roll; and WHEREAS, Article XllI D, Section 6 of the California Constitution, as adopted by passage of Proposition 218 on November 5, 1996, established procedures for levying new charges; and WHEREAS, a written report identifying each parcel of real property to be annexed and to receive extended services, and the amount of the new charge for each parcel for 1999-2000 and future years, has been tiled with the Clerk of the Board of Supervisors and resides in the Property Tax Section of the Auditor's Office; an d WHEREAS, notice having been duly given and a public hearing having been held to consider I establishing such new service charge i~r fiscal year 1999-2000 on the parcel to ee annexed, and to consider protests against such service charge, in accordance with the procedures specified in Article XIII D, Section 6, of the California Constitution; and WHEREAS, a ballot proceeding was held in connection with said hearing and a majority of the ballots submitted were in favor of the proposed service charge. NOW, THEREFORE, BE IT RESOLVED, 1. It is found that a majority of the ballots submitted were in favor of the proposed service charge being established. 2. In cccordance with Article XIII D, Section 6, of the California Constitution a maximum service charge is hereby established for fiscal year 1999-2000 and for future fiscal years in the amount of $ 1,000.00 per parse] of real property to be annexed to the County Service Area, as shown on the current tax roll. 3. A service charge up to the maximum rate of $1,000.00 per parcel of real property shall be imposed on the property in question upon its annexation to the County Service Area.
