T 7~{{°!`..~ resolution lUo. 99-53 RESOLUTION ESTABLISI-IING AN ORDERLY SYSTEM FOR DESTRUCTION OF RECORDS WITHIN TIIE PERSONNEL DEPARTMEN"f WI-IEREAS, the establishment of an orderly system of destruction of records within the Personnel Office pursuant to Government Code Sections 12946 and 26202 is desirable; WHEREAS, Section 12946 of the California Government Code provides that the Personnel Department must maintain and preserve any and all applications, personnel, membership, or employment referral records and files for a minimum period of two years after the records and files are initially created or received and must retain personnel files of applicants or terminated employees 1`or a minimum period of two years after the date of the employment action taken; and WHEREAS, Section 12946 of the California Government Code provides that the legal requirement for retention of recruitment and examination records does not extend beyond the two year period except in the event of an investigation, complaint or claim filed and pending against the County; in which case records must be retained until the issue is resolved and all appeals or related proceedings have terminated; and WHEREAS, Section 26202 of the California Government Code permits this Board, by 4lSths vote, to authorize the destruction of old personnel records providing said records are no longer necessary or required for County purposes. NOW THEREFORE, BE IT RESOLVED as follows: 1) An orderly system for the destruction of nonjudicial public records, documents, instruments, books, and papers in the custody of the Personnel Department is hereby established in this County as set forth below: (1) The Director -Personnel, who has custody of nonjudicial public records, documents, instruments, books, papers and files, may authorize the destruction of or other disposition of those nonjudicial public records, documents, instruments, books, papers and files hereafter described on the conditions hereinafter set forth in Exhibit "A"; and Page 1 of 5 (2) This resolution may be amended from time to time by additions, deletions, or amendments thereto by further resolution of this Board which shall make specific reference hereto and incorporate all the provisions hereof unaffected by said amendments.
