'f~ ~ ~... ~.) jr^~ ICJ ~ ~0~~#'C~' Ca F' ~t~tT~~,~^, STATE (~F QACIfURNIA ,~ Resolution No. ~9--6g RESOLUTION APPROVING LOCAL FEASIBILITY COST SHARING AGREEMENT WITH THE RECLAMATION BOARD AND REQUESTING THE RECLAMATION BOARD ENTER INTO A SIMILAR AGREEMENT WITH THE U.S. ARMY CORPS OF ENGINEERS WHEREAS, the County of Butte has suffered extensive flood damages in the Rock Creek -Keefer Slough area over the past five years, and there have been four Presidential declarations of disaster including this area during said time period; and WHEREAS, the topography of the watershed promotes flash flooding with 3,500 feet of fall in the upper 15 miles of the watershed and only 280 feet of fall in the fast 15 miles; and WHEREAS, flooding has threatened commerce due to the repeated closures of both Highway 99 and Highway 32, and compromised access to the Chico Municipal Airport; and WHEREAS, the residents of the valley and agricultural interests have suffered a minimum of $10,000,000 in damages to infrastructure, residences, other structures and crops in each of the declared flood disasters; and WHEREAS, Federal Emergency Management Agency (FEMA) Flood Insurance Rate Maps (FIRM), effective September 29, 1989, were adopted by the Board of Supervisors, and construction was thereafter allowed, in reliance on said FIRM maps, outside the designated flood plains as indicated on said maps; however, certain of those construction sites were subsequently flooded at least four times; and WHEREAS, the Board of Supervisors on February 9, 1999, approved a Contribution Agreement with the STATE OF CALIFORNIA, Department of Transportation (CalTrans), wherein CalTrans agreed to provide funds for a project Feasibility Study; and WHEREAS, local solutions to this problem have been developed and the U.S. Army Corps of Engineers (Corps) has prepared a Project Study Plan (PSP) and is prepared to enter into a Feasibility Cost Sharing Agreement (FCSA) with The Reclamation Board, to define the most feasible project to reduce or eliminate these flooding problems; and WHEREAS, The Reclamation Board is willing to enter into said agreement with the Carps after this Board of Supervisors has approved and signed the Local Feasibility Cost Sharing Agreement (LFCSA) between The Reclamation Board and the County of Butte; and NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors, that a flood control project is necessary in the Rock Creek-Keefer Slough area to protect the health, safety and welfare of the residents of Butte County, and to expedite said project this Board takes the following actions: 1. The Project Study Plan (PSP) is approved and Jane Dolan, Chair of the Board of Supervisors and Mike Crump, Director of Public Works, are authorized to sign said PSP on behalf of the County of Butte. 2. The Local Feasibility Cost Sharing Agreement (LFCSA) is approved and Jane Dolan, Chair of the Board of Supervisors and Mike Crump, Director of Public Works, are authorized to sign said LFCSA on behalf of the County of Butte. 3. Jane Dolan, Chair of the Board of Supervisors, is authorized to send a letter to The Reclamation Board requesting said Board to approve the PSP and LFCSA at their May 21, 1999, meeting.
