[LOVING THE ANNEXATION TO COUNTY SERVICE AREA NO. 23 PLEASANT VALLEY DRAINAGE DISTRICT WHEREAS, pursuant to Title III, Division 3, Part 3, Chapter 1 of the Government Code of the State of California, commencing with Section 56650, Jeff Farrar has petitioned the Local Agency Formation Commission ("LAFCO") for the annexation of the Jeff Farrar Parcel Map No. 98-1 to County Service Area No. 23 (Pleasant Valley Drainage District); and WHEREAS, on September 3, 1998, LAFCO adopted and passed Resolution No. 1 1998/99 making determinations and approving the annexation of the Jeff Farrar Parcel Map No. 98-1 to County Service Area No. 23; and WHEREAS, the Local Agency Formation Commission has certified that it has reviewed and considered the Negative Declaration adopted by the City of Chico on July 21, 1998 which does not identify any significant impacts associated with the annexation and there are no sufficient grounds to require supplementing the environmental documents prepared by the City of Chico; and WHEREAS, said Resolution adapted and passed. by LAFCo authorized the Board of Supervisors of the County of Butte to conduct proceedings for the annexation to County Service Area No. 23 without notice and hearing and the Board may proceed in such manner pursuant to Government Code Section 57002(c). NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPF,RVISORS OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, as follows: 1. Said Board hereby finds and determines that the proceedings herein were conducted pursuant to Section 56650 et. seq. of the Government Code. 2. Said Board hereby determines to approve the annexation to County Service Area No. 23 as specified below. 3. The Board hereby determines to approve the annexation of the Jeff Farrar Parcel Map No. 98-2 to said County Service Area No. 23 (Pleasant Valley Drainage) without notice and hearing. 4. The subject area includes approximately 5.81 acres of private property and is identified as APN's 048-061-038 and 048-061-042. 5. The boundaries of the annexation to said County Service Area No. 23 are hereby finally determined and established to be the same as shown on Exhibit "A" attached hereto and incorporated herein. and made a part hereof by this reference. 6. The subject annexation is assigned. the following short form designation: 98-32 -Annexation to County Service Area No. 23 (Pleasant Valley Drainage District). 7. The reason for the annexation to County Service Area No. 23 is to utilize district drainage facilities as a condition of permit approval for development of the property. 8. All appropriate state and local fees shall be paid by the landowner. 9. In accordance with the provisions of Government Code Section 25210.77(a) and Butte County Code Sections 21.85 through 21.90, aper-parcel service charge shall be Levied against all the parcels within County Service Area No. 23. Each parcel shall be assessed an individual service charge based upon. benefit. Said charge shall appear as a separate item on the tax bill and shall be collected at the same time and in the same manner as ordinary County ad valorem taxes are collected and shall be subject to the same penalties and the same procedure and sale in the case of delinquency as provided for such. taxes. Ali laws applicable to the levy, collection and enforcement of County ad valorem taxes are collected and shall be subject to the same penalties and the same procedure and sale in the case of delinquency as provided for such taxes. All laws applicable to the levy, collection and enforcement of County ad valorem taxes shall be applicable to such charge, except that if real property to which such charge relates has been transferred or conveyed to a bona fide purchaser for value, or if a Lien of a bona fide encumbrance for value has been created and attached thereon, prior to the date on which the first installment of said taxes would become delinquent, then the charge confirmed shall not result in a lien against said real property but instead shall be transferred to the ~msecured roll for collection. 10. Currently, there is no additional charge to fund the drainage services within County Service Area No. 23. Any new andlor increased charges would need to be processed in accordance with. the provisions of~ Proposition 2l 8.
