HomeMy WebLinkAbout99-087r ,. i.• -~ ._ . ~~~~ Resolution No. 99-87 RESOLUTION OF BOARD OF SUPERVISORS APPROVING PETITION FOR AND FORMATION OF A RECLAMATION DISTRICT TO BE KNOWN AS THE SACRAMENTO RIVER RECLAMATION DISTRICT WHEREAS, pursuant to Title III, Division 3, Part 3, Chapter I of the Government Code of the State of California, commencing with Section 56650, Ciruela Rancho, Deseret Farms, and Jim and Shirley Lewis have petitioned the Local Agency Formation Commission ("LAFCO") for the formation of a reclamation district to be known as the Sacramento River Reclamation District ("District"); and WHEREAS, LAFCo has certified that it has independently reviewed, analyzed, and considered the Negative Declaration with mitigation measures prior to making its decision on the project, and the Negative Declaration with mitigation measures reflects the independent judgement of LAFCo; and WHEREAS, the petitioners for formation of the Sacramento River Reclamation District have waived their right to any portion of property tax revenues collected in the subject area; and WHEREAS, pursuant to Government Code Section 56841, LAFCO found that there is a need for the services and organizational structure which the proposed District is capable of providing within the ten-itory of the proposed District within Butte County, and there is inadequate existing local governmental authority and resources to provide these services in the area of the proposed District to currently deal with the needs of these lands relating to flooding from the Sacramento River: threats of flooding, erosion and deposition of flood-borne materials; the need for coordination of efforts by private landowners to provide for the maintenance of existing land features in the face of flooding and erosion threats, including existing levees; and the coordination of their land uses to minimize damage and injury to property, and potential injury to life, from flooding; and 1 WHEREAS, LAFCo found that the proposed District will encourage the maintenance and protection of agriculture uses within the District boundaries and will have no significant identified impact or affect upon adjacent areas not included within the District boundaries and land uses within these areas. WHEREAS, on May 6, 1999, LAFCO adopted and passed Resolution No. 25 1998/99 making determinations and approving the formation of the District and has submitted the matter to the Board of Supervisors of the County of Butte, as the conducting authority, for further proceedings; and WHEREAS, pursuant to Government Code Section 57000 et. seq. and Water Code Section 50302, the Board of Supervisors ("Board") of the County of Butte has held a duly noticed public hearing regarding the Petition and Formation of the Sacramento River Reclamation District. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, as follows: Section 1. Environmental Findings: A. The Board of Supervisors has reviewed and considered the Negative Declaration with mitigation measures prior to making its decision on the project, and the Negative Declaration with mitigation measures reflects the independent judgement of said Board. Section 2. Genes al Findings and Conditions: A. The Board of Supervisors finds that the statements within the Petition are true and correct and hereby approves the Petition for Formation of the Sacramento River Reclamation District, subject to the conditions established by LAFCo. The District is ordered formed, and the District boundaries are established as described in Exhibit A, which description omits the Tehama County lands included in the original Petition, as ordered by LAFCo and which order is hereby confirmed. Section 3. Adoption and implementation of LAFCo Conditions: A. The formation of the District was approved by the LAFCo upon the condition that: 2 1. The land owners within the proposed District, as determined utilizing the regular county assessment roll, shall, by ballot proceeding pursuant to the requirements of Proposition 218, approve an assessment in the amount of $4.00 per acre on the real property included within the District. 2. No portion of the property taxes and assessments of the County of Butte shall be assigned or transferred to the proposed District. Pursuant to California Government Code 56842 (a)(2), LAFCo agreed to the waiver of property tax revenues and required the Board of Supervisors and the newly formed District Board of Trustees to execute a Tax Agreement setting forth the waiver of property tax revenues by the District. One copy of the executed tax agreement is to be forwarded to LAFCo. 3. The appropriation limit established pursuant to Government Code Section 56842.5 shall initially be the amount of $4.00 per acre multiplied by the number of acres included within the District. The appropriation limit shall be modified thereafter upward or downward by the amount of assessments approved by a majority of the voters of the District at a duly called election pursuant to Proposition 218 and legislation implementing its terms. 4. The number of Trustees of the Reclamation District shall be seven. 5. The question of whether all elections shall be conducted by all mail ballot shall be placed upon the ballot by the Board of Supervisors. 6. The Sacramento River Reclamation District shall not, in exercising its powers received under its ordinances, regulation or codes, assume any of the power and authority of the County of Butte relating to regulation of the use of land, granting or 3 denying building permits or similar powers and land use exercisable by the County of Butte, except by specific written delegation from the County of Butte. B. All Butte County and State of California fees must be paid in full prior to the Executive Officer of LAFCo filing the Certificate of Completion. C. The map and legal description, if rejected by the State Board of Equalization, shall be revised at the expense of the applicant, prior to filing the Certificate of Completion. D. The Sphere of Influence of the Sacramento River Reclamation District shall be co-terminus with approved District boundaries, as described in Exhibit "A". Section 5. The Clerk of the Board is authorized and directed to: file a certified copy of this Resolution with the Executive Officer of the LAFCo; record this Resolution, the Petition and legal description included within Exhibit "A" with the Butte County Recorder; and certify and send to the State Lands Commission a copy of the Petition and this Resolution, pursuant to Water Code Section 50322. DAVIS Fifth District ITEM SUBJECT: Sacramento River Reclamation District -Resolution Direction Amendment ITEM DESCRIPTION: Resolution 99-87, providing for the formation of the Sacramento River Reclamation District, directed that the petition for formation of the district be recorded with the resolution. The original petition included lands that were excluded by the Board, therefore, the petition would not represent the lands as described by the resolution. The Clerk of the Board has consulted with County Counsel and the petitioner's attorney on this matter and has been advised to record the resolution without the petition. Board approval is requested to accept the recommendation of County Counsel and record the resolution without the petition. MEETING DATE: December 7, 1999 BOARD ACTION TAKEN: Moved to amend Board direction of June 22, 1999, to exclude recording of the petition.
