RESOLUTION FOR SUMMARY ABANDONMENT' FOR
A PORTION OF E~iCESS RIGHT OF WAY, BETWEEN THE NORTH RIGHT OF WAY
LINE OF KUSEL ROAD AND THE SOUTH RIGHT OF WAY LINE OF OPHIR ROAD,
A PORTION OF THE OLD SOUTHERN PACIFIC RAILROAD (S.P.R.R.) RIGHT OF WAY
WHEREAS, a portion of excess right of «~ay is no longer necessary or required for road
purposes; and
WHEREAS, pw-suant to the Streets and Highways Code Section Division 9, Part 3, Chapter
4, commencing with Section No. 8330, the Board finds that a portion of excess right of way should
be summarily vacated;
NOW, THEREFORE, BE IT RESOLVEll by the Board of Supervisors of the County of
Butte, State of California, as follows:
The following described portion of excess right of way is hereby summarily vacated and
abandoned pursuant to Streets and Highways Code Section Division 9, Part 3, Chapter 4,
commencing with Section No. 8330:
Being that certain 100 foot wide old Southern Pacific Railroad right of way, granted by
quitclaim deed from Southern Pacific Transportation Company, a Delaware Corporation, to
the County of Butte, dated September 13, 1978, and recorded in the Office of the Recorder of
the County of Butte, State of California on October 23, 1978, in book 2337 Official Records
at page 125, and also lying within the north half of section 32, T19N, R4E, M.D.M.
Beginning at the point of intersection of the westerly right of way line of said abandoned
S.P.R.R. with the northerly right of way line of Kusel Road. Thence in a northeasterly
direction along said railroad right of way 2,070 feet more or less to its point of intersection
with the southerly right of way line of Ophir Road. Thence easterly along said southerly right
of way line 120 feet more or less to its intersection with the easterly right of way line of said
abandoned railroad. Thence in a southwesterly direction along said S.P.R.R. right of way
2,040 feet more or less to its intersection with the northerly right of way line of said Kusel
Road. Thence in a westerly direction along said right of way line 120 feet more or less to the
point of beginning, containing 4.7+ acres
And from and after the date the Resolution is recorded, the public right of way vacated no
longer constitutes a public right of way.
